The Council of Ministers of B-H defined by majority vote a Bill on Travel Documents of B-H. 

It was concluded that the Bill should be submitted to the Parliamentarian Assembly of B-H for consideration under the regular legislative procedure.

The Council of Ministers of B-H defined a Bill on Amendments and Supplements of the Law on ID card of Citizens of Bosnia and Herzegovina.

The Bill was developed in an identical form as the Law, promulgated by the High Representative, based on his authorisations.

It was concluded that the Bill should be submitted to the Parliamentarian Assembly of B-H for consideration under the urgent legislative procedure.

The Council of Ministers returned a Bill on Amendments and Supplements of the Law on Salaries and Allowances in B-H Institutions for further improvement.

The Council of Ministers defined, by majority vote, a Bill on Amendments and Supplements to the Law on Ministries and Other Administrative Bodies of Bosnia and Herzegovina.

The proposer, Ministry of Justice, will submit the Bill to the Parliamentarian Assembly of B-H for consideration under the urgent legislative procedure.

The Council of Ministers of B-H defined a Bill on Amendments and Supplements to the Law on Judicial Exam in Bosnia and Herzegovina.

The proposer, Ministry of Justice, will submit the Bill to the Parliamentarian Assembly of B-H for consideration under the regular legislative procedure.

The Council of Ministers of B-H defined a Proposal Agreement between the Council of Ministers of Bosnia and Herzegovina and Government of the Republic of Serbia on Cooperation in Protection from Natural and Man Made Disasters, and adopted the Official Minutes from the negotiations.

The proposer, Ministry of Security, will submit the Proposal Agreement to the Presidency of B-H, and Minister of Security Sadik Ahmetović is proposed as the signatory on behalf of B-H.

The Council of Ministers of B-H defined a Proposal Protocol on Development of Tourism within the Adrian-Ionic Initiative, and adopted a report on the negotiations held.

The proposer, Ministry of Foreign Trade and Economic Relations, will submit the Proposal Protocol to the Presidency of B-H for further procedure, and Minister and Foreign Trade and Economic Relations Mladen Zirojević is proposed as the B-H signatory of the Protocol on behalf of B-H.

The Council of Ministers of B-H defined a Proposal Memorandum between the Council of Ministers of the Republic of Albania and Council of Ministers of Bosnia and Herzegovina, Government of the Republic of Macedonia, Government of the Republic of Serbia, Government of the Republic of Slovenia, Government of the Republic of Croatia and Government of the Republic of Montenegro on Settlement of Debt of the Republic of Albania Based on Commodity Exchange between the Republic of Albania and Former Socialist Federative Republic of Yugoslavia, and adopted a report on the negotiations held.

The proposer, Ministry of Finance and Treasury, will submit the Proposal Memorandum to the Presidency of B-H for further procedure, and Ljubiša Vladušić, authorised representative of B-H to the Committee for Annex C of the Agreement on Succession Issues, is proposed as the signatory of the Memorandum on behalf of B-H.

The Council of Ministers of B-H defined a Proposal Basis for conclusion of a Loan Contract between Bosnia and Herzegovina and the European Bank for Reconstruction and Development for Sarajevo Water Supply and Sanitation Project.

The proposer, Ministry of Finance and Treasury, will submit the Proposal Basis to the Presidency of B-H for further procedure, and Minister of Finance and Treasury Dragan Vrankić is proposed as the signatory of the Contract on behalf of B-H.

The Council of Ministers of B-H defined a Proposal Basis for negotiations for conclusion of an Agreement on Cooperation of Search and Rescue Services of Bosnia and Herzegovina and the Republic of Serbia.

The proposer, Ministry of Transport and Communications, will submit the Proposal Basis to the Presidency of B-H for further procedure, and Minister of Transport and Communications is proposed for the signatory of the Agreement on behalf of B-H.

The Council of Ministers of B-H defined a Proposal Basis for negotiations for conclusion of an Agreement on Cooperation of Search and Rescue Services of Bosnia and Herzegovina and the Republic of Croatia.

The proposer, Ministry of Transport and Communications, will submit the Proposal Basis to the Presidency of B-H for further procedure, and Minister of Transport and Communications is proposed for the signatory of the Agreement on behalf of B-H.

The Council of Ministers of B-H defined a Proposal Basis for negotiations for conclusion of an Agreement on Cooperation of Search and Rescue Services of Bosnia and Herzegovina and Montenegro.

The proposer, Ministry of Transport and Communications, will submit the Proposal Basis to the Presidency of B-H for further procedure, and Minister of Transport and Communications is proposed for the signatory of the Agreement on behalf of B-H.

The Council of Ministers of B-H defined a Proposal Basis for negotiations for the conclusion of an Agreement between Bosnia and Herzegovina and Montenegro on Promotion and Protection of Investments.

The proposer, Ministry of Foreign Trade and Economic Relations, will submit the Proposal Basis to the Presidency of B-H for further procedure, and Minister of Foreign Trade and Economic Relations Mladen Zirojević is proposed as the signatory of the Agreement on behalf of B-H.

The Council of Ministers of B-H defined a Proposal Basis for negotiations for attaining membership of Bosnia and Herzegovina in the European Committee for Prevention of Foot and Mouth Disease within the United Nations Food and Agriculture Organisation, by accepting the of EUFMD Constitution.

The proposer, Ministry of Foreign Trade and Economic Relations, will submit the Proposal Basis to the Presidency of B-H for further procedure, and Minister of Foreign Trade and Economic Relations Mladen Zirojević is proposed as the signatory of an Instrument on Accepting EUFMD Constitution.

The Council of Ministers of B-H defined a Proposal Basis for initiating a procedure for Bosnia and Herzegovina’s joining the Nairobi Treaty on Protection of Olympic Symbol.

The proposer, Ministry of Foreign Trade and Economic Relations, will submit the Proposal Basis to the Presidency of B-H for further procedure.

The Council of Ministers of B-H defined a Proposal Basis for Bosnia and Herzegovina’s joining the Organisation for European Public Law.

The proposer, Ministry of Justice , will submit the Proposal Basis to the Presidency of B-H for further procedure.

The Council of Ministers of B-H defined a Proposal Basis for negotiations and conclusion of a Contract between Bosnia and Herzegovina and the Republic of Macedonia on Amendments and Supplements of the Contract between Bosnia and Herzegovina and the Republic of Macedonia on Mutual Execution of Judicial Decisions in Criminal Matters.

The Proposer, Ministry of Justice, will submit the Proposal Basis to the Presidency of B-H, and Minister of Justice is proposed for the signatory of the Contract on behalf of B-H.

The Council of Ministers of B-H defined a Proposal Basis for negotiations and conclusion of a Contract between Bosnia and Herzegovina and the Republic of Macedonia on Amendments and Supplements of the Contract between Bosnia and Herzegovina and the Republic of Macedonia on Legal Assistance in Civic and Criminal Matters.

The Proposer, Ministry of Justice, will submit the Proposal Basis to the Presidency of B-H, and Minister of Justice is proposed for the signatory of the Contract on behalf of B-H.

The Council of Ministers of B-H defined the following proposal decisions on ratification of agreements and a Facultative Protocol:

-          Proposal Decision on Ratification of an Agreement on Loan Guarantees for the Water Supply and Sanitation Enterprise (“Vodovod i Kanalizacija”), Bijeljina, between Bosnia and Herzegovina and the European Bank for Reconstruction and Development;

-          Proposal Decision on Ratification of an Agreement on Agricultural Cooperation between the Ministry of Foreign Trade and Economic Relations of Bosnia and Herzegovina and Ministry of Agriculture and Rural Development of the Republic of Poland;

-          Proposal Decision on Ratification of an Agreement on Avoidance of Double Taxation and Prevention of Fiscal Evasion in Respect to Taxes on Income between Bosnia and Herzegovina and the State of Qatar;

-          Proposal Decision on Ratification of a Facultative Protocol accompanying the International Treaty on Economic, Social and Cultural Rights.

The proposer, Ministry of Foreign Affairs, will submit the proposal decisions to the Presidency of B-H for adoption.

Upon a proposal by the Ministry of Security the Council of Ministers of B-H adopted a Decision to set up bodies for monitoring of implementation of the B-H Strategy for Prevention and Fight against Terrorism and Related Action Plans.

Upon a proposal by the Ministry of Transport and Communications, the Council of Ministers of B-H adopted a Decision on financing the implementation of obligations under the Law on Work Time, Obligatory Holidays of Mobile Workers and Monitoring Devices in Road Traffic, from the accumulated revenue surplus of the Communications Regulatory Agency of Bosnia and Herzegovina.

Upon a proposal by the Ministry of Transport and Communications, the Council of Ministers of B-H adopted a Decision on use of a part of funds from the accumulated revenue surplus of the Communications Regulatory Agency of Bosnia and Herzegovina, in amount of KM 520,000.00 for the procurement and equipping of premises for the Monitoring and Equipping Radio-Frequency Spectre Division.

The Council of Ministers of B-H postponed the adoption of a Proposal Decision on the use of a part of funds from the accumulated revenue surplus of the Communications Regulatory Agency of Bosnia and Herzegovina, in amount of KM 2,952,000.00 for financing of a part of the B-H Public Broadcasting Service Microwave Connection Digitalisation Project (procurement of radar for covering Eastern Sarajevo, Bijeljina, Brčko, Tuzla and Zenica with digital signal and for financing the Development of Radio-TV Satellite System Project in the area of Mostar).

The Council of Ministers of B-H charged the Ministry of Transport and Communications to conduct a public competition procedure for selection of Manager of the Railways of Bosnia and Herzegovina Regulatory Board, in accordance with the Law.

Upon a proposal by the Ministry of Justice, the Council of Ministers of B-H adopted a Decision on Appointment of a Committee for Sign Language in Bosnia and Herzegovina.

Upon a proposal by the Ministry for Human Rights and Refugees, the Council of Ministers of B-H adopted a Decision on setting up the Council for Persons with Disabilities in Bosnia and Herzegovina, together with suggestions presented at the session.

Upon a proposal by the Ministry of Civil Affairs, the Council of Ministers of B-H adopted a Decision on Reimbursements Levels for Work at the Council for Science of Bosnia and Herzegovina.

According to the Decision, the level of reimbursement for President of the Council was set at the level of KM 500.00 and for Council members at KM 400.00.

The Council of Ministers of B-H adopted a Decision on Amendments and Supplements to the Decision on Reimbursement Levels for Work at the Managing Board of the Centre for Information on and Validation of High Education Documents.

Upon a proposal by the Ministry o Justice, the Council of Ministers of B-H adopted a Decision on Reimbursement Level for Work of the Expert Council for Monitoring, Studying and Improvement of the Sanction Execution System.

Under this Decision, the level of reimbursement for President of the Expert Council was set at the level of KM 250.00, for Council members at KM 200.00, and for the Council Secretary at KM 200.00.

Upon proposal by the Ministry of Foreign Trade and Economic Relations, the Council of Ministers of B-H adopted a Decision on Amendment and Supplements to the Decision on Ban of Import of Certain Packages for the Purpose of Prevention of Foot and Mouth Disease in Bosnia and Herzegovina.

The Council of Ministers of B-H adopted a Report of the Ministry of Security about a need for construction and related cost evaluation of a building for the Agency for Staff Education and Expert Training in Mostar, No. 20-1-50-51/09, of September 17, 2009, and approved planning of multiyear capital investment for the Project of Construction of Building for Permanent Accommodation and Operation of the Agency for Staff Education and Expert Training in Mostar, by phases and for amount as provided for in the Report.

The Council of Ministers also concluded the following:

-          To accept the estimated price of the  Project of Construction of a Building for Permanent Accommodation and Operation of the Agency for Staff Education and Expert Training in Mostar, in amount of KM 8,194,446.00;

-          To accept the financial construction of the Project of Construction of a Building for the Agency for Staff Education and Expert Training , according to which the funds for the project implementation will be planned and provided for in the Budget of B-H Institutions and International Obligations of B-H under the following dynamics, as  defined in the Report:

(a)    Year 2010 – provision of funds in amount of KM 1,008,540.00 for Phase I;

(b)   Year 2011 – provision of funds in amount of KM 3,600,090.00 for Phase II; and

(c)    Year 2012 – provision of funds in amount of KM 3,585,816.00 for Phase III.

The Agency for Staff Education and Expert Training  is responsible to make provision for the funds, in cooperation with the Ministry of Finance and Treasury, in the Draft Law on Budget of B-H Institutions and International Obligations of B-H for year 2010, including a multiyear capital investment of the Agency for Staff Education and Expert Training for years 2010, 2011 and 2012 (Table No. 5), provided that the planned project should also be included in the next budget cycle in the Budget Framework Document for Period 2011 – 2013, in accordance with Budget capacities and annual plans.

The Council of Ministers considered and adopted a Report of the Ministry of Transport and Communications on the issue of permanent accommodation of the B-H Railways Regulatory Board in Doboj, and concluded the following:

-          The Ministry of Transport and Communications is in charge to prepare a Proposal Decision on allocation of funds from the reserves of the 2010 Budget of B-H Institutions and International Obligations of B-H for purchase of a parcel for construction of business premises for the permanent accommodation of the B-H Railways Regulatory Board in Doboj, and to forward the Proposal Decision to the Council of Ministers for consideration and adoption; and

-          The Minister of Transport and Communications is responsible for the project implementation.

The Council of Ministers of B-H considered and adopted a Report of the Ministry of Foreign Affairs on Capital Investment in 2010, namely: purchase, adaptation and equipping the buildings of the diplomatic-consular offices of Bosnia and Herzegovina in Berlin, Belgrade and Zagreb, of a total value of KM 4,800,000.00, which refers specifically to the following:

(a)    A purchase, adaptation and equipping of the building in Berlin, of 517 m2 size and total value of KM 1,500,000.00;

(b)   A purchase, adaptation and equipping of the building in Belgrade, of 500 m2 size and total value of KM 1,600,000.00; and

(c)    A purchase, adaptation and equipping of the building in Zagreb, of 500 m2 size and total value of KM 1,700,000.00.

The realisation of the capital investment will be funded from the capital investment part of 2010 Budget of B-H.

The Council of Ministers also adopted a Decision on Approval of 2010 Capital Investment Project for purchase, adaptation and equipping of the diplomatic-consular office buildings of Bosnia and Herzegovina in Berlin, Belgrade and Zagreb.

The Council of Ministers of B-H considered and adopted a Report of the Ministry of Justice on Activities Undertaken for Solving the Issue of Recovery of Approved Loan Back to the Budget of B-H Institutions and International Obligations of B-H, under the Council of Ministers Decision No. 153/07, of November 29, 2007, and concluded the following:

-          The Office of Attorney General of B-H is charge to undertake all necessary activities, in cooperation with the High Prosecutorial and Judicial Council of B-H, Ministry of Finance and Treasury of B-H, and Ministry of Justice of B-H, to recover the funds of the loan paid to the High Prosecutorial and Judicial Council of B-H back to the Budget of B-H Institutions and International Obligations of B-H;

-          The Office of Attorney General of B-H is in charge to inform the Council of Ministers of B-H on the related activities;

-          The High Prosecutorial and Judicial Council of B-H, Ministry of Finance and Treasury of B-H and Ministry of Justice of B-H are in charge to provide to Office of Attorney

General of B-H all needed information in order to facilitate funds transfer to the Budget of B-H Institutions.

The Council of Ministers of B-H considered and adopted the following individual reports prepared by the Ministry of Foreign Trade and Economic Relations:

- Report on supervision of application of Regulations on special conditions of registering and marking the flour to be marketed for the period January 1 – June 30, 2010.

- Report on verification of B-H origin of merchandise cleared under FORM from for period January 1 – June 30, 2010.

Based on information presented, the Council of Ministers concluded that the Decision on Preferential Treatment of B-H Goods, classified under FORM origin form, is fully complied with.

The Ministry of Foreign Trade and Economic Relations is in charge to request, in cooperation with the Ministry of Foreign Affairs, through support of B-H diplomatic-consular offices, a special treatment of B-H goods from the countries such as Libya, China, India and other countries buyers of B-H goods.

The Council of Ministers of B-H considered and adopted a Report from the Ministry of Civil Affairs on a need to solve the status of equipment, inventory, supplies, archives and documentation from the official premises of the B-H Institute for Health Care, and concluded the following:

-          The Agency for Civil Service of B-H is in charge to prepare and submit a Proposal Decision on solving the status of Arif Smajkić, remaining employee in the B-H Institute for Health Care, for the first next session of the Council of Ministers;

-          The Ministry of Civil Affairs is in charge to make urgent inventory and valuate the property, rights and obligations of the B-H Institute for Health Care, and on base of that, propose the solution for the status of equipment, inventory, supplies, archives and documentation from the official premises of the B-H Institute for Health Care of B-H.

The Council of Ministers of B-H proposed a Report and proposal solution for the issue of remaining obligations of the Committee for Property Claims of Displaced Persons and Refugees.

The Ministry of Finance and Treasury and Ministry of Justice are in charge to find solution to this issue and propose a decision thereon.

The Council of Ministers of B-H considered and adopted a Report on certain aspects of development of the Agency for Forensic Investigation and Expertise.

The Council of Ministers supports the efforts of the Agency for Forensic Investigation and Expertise to meet organisational, material-technical and staff requirements for a successful operation, based on the Law.

The Council of Ministers of B-H adopted Regulations on Implementation of Analytical Methods and Interpretation of Results, upon a proposal of the Ministry of Foreign Trade and Economic Relations.

The Council of Ministers gave individual consents to specifications of working places for secondary education level, classified by salary categories, in the following institutions:

-          The Secretariat-General of the Council of Ministers of B-H:

-           Office of Chairman of the Council of Ministers;

-           Information-Security Advisory Service within the Office of Chairman of the Council of Ministers of B-H;

-          Foreign Investment Promotion Agency; and

-          Agency for Postal Traffic in B-H.

The Council of Ministers gave the following individual consents to specifications of working places for secondary education level, classified by salary categories, with an obligation to have all the specifications harmonised with the Opinion of the Ministry of Finance and Treasury:

-          Agency for Forensic Investigation and Expertise;

-          Indirect Taxation Administration;

-          Procurement Review Body;

-          Legislative Office of B-H;

-          Intelligence-Security Agency of B-H;

-          Ministry of Foreign Affairs ;

-          Archive of Bosnia and Herzegovina;

-          Service for Foreigners’ Affaires;

-          Ministry for Human Rights and Refugees;

-          Office of Attorney-General of Bosnia and Herzegovina;

-          Agency for Market Monitoring; and

-          Institute for Missing Persons of B-H.

Upon a proposal by the Ministry of Finance and Treasury The Council of Ministers of B-H defined an Opinion to a Bill on Amendments and Supplements to the Law on Central Bank of Bosnia and Herzegovina, as proposed by Deputy in the House of Representatives of the Parliamentarian Assembly of B-H Sefer Halilović.

The Ministry of Finance and Treasury is charged to submit the Opinion to the Parliamentarian Assembly of B-H.

The Council of Ministers of B-H appointed the following members of the Foreign Investment Promotion Agency Steering Board for a two year term:

-          Zvomnimir Kutleša and

-          Aleksandar Obradović.

The Council of Ministers of B-H decided to propose to the Agency for Civil Service of B-H the following members of the Committee for Selection of Manager in the Institute for Measurement:

-          Biljana Čamur; and

-          Fazlila Musić.

The Council of Ministers was informed of a Decision of the B-H Concessions Committee on the Termination of Two-Year Mandate of Mensur Šehagić, member of the Concessions Committee of Bosnia and Herzegovina, appointed at the Committee’s first sitting.

As a job competition was published after the expiration of mandates of all other B-H Concessions Committee members, it was concluded that the same procedure should be followed in this particular case.

In that regard, the Ministry of Foreign Trade and Economic Relations is charged to develop a Proposal Decision on Appointment of the Committee for Competition Advertisement and Selection Procedures for adoption by the Council of Ministers.

The Council of Ministers defined responses to Deputies’ inquiries, as follows:

-          By the Ministry of Foreign Trade and Economic Relations to the inquiry of Slobodan Šaraba and Selim Bešlagić;

-          By the Ministry of Justice to the inquiry of Šemsudin Mehmedović.

The Secretariat-General of the Council of Ministers will provide responses to the Parliamentarian Assembly of B-H.

The Council of Ministers took a Decision, upon a proposal by the Ministry of Foreign Trade and Economic Relations, on establishment of a body in charge for the implementation of clean development mechanism projects under the Kyoto Protocol of the UN Framework Convention on Climate Change in Bosnia and Herzegovina.

The Council of Ministers was informed of a request for visa issuance to citizens of Kosovo for their participation at the 8th Regional EDC/HRE Conference for SEE Network, to be held on October 21 and 22, 2010 in Sarajevo.

In that regard and in compliance with the Conclusion from the 86th session of the Council of Ministers, of May 7, 2009, made in relation to the position of the Presidency of B-H on the issue of legality of documents possessed by citizens of Kosovo, the Council of Ministers authorised the Ministry of Foreign Affairs to issue entry visas on a separate piece of paper for two persons from the list accompanying the request, who are to take part at the 8th Regional EDC/HRE Conference for SEE Network, to be held on October 21 and 22, 2010 in Sarajevo for the period of the Conference.

The Secretariat-General is in charge to provide the Conclusion to the Ministry of Foreign Affairs for further procedure.

Upon a proposal by the Ministry of Justice, the Council of Ministers of B-H adopted a Decision on Temporary Freezing of Funds and Economic Means of the Persons Indicted before the International Criminal Court for Former Yugoslavia, who are unavailable to the Court.

The Council of Ministers of B-H adopted a Report of the Ministry of Transport and Communications on Licensing of Transporters in International Road Transport.

The Border Police of B-H is charged to prolong the application of the Protocol between the Ministry of Transport and Communications, Border Police, Inspectorate of Repubika Srpska and Inspectorate of the Federation of B-H to June 30, 2011.
