Council of Ministers of B-H holds its 136th session

The proposer, Ministry of Foreign Affairs, will deliver the Proposal Note Agreement for further procedure, and the Minister of Foreign Affairs of B-H is proposed for the signatory on behalf of B-H.
The Council of Ministers granted its consent to the proposed text of Exchange of Notes between the Council of Ministers of Bosnia and Herzegovina and Government of the Federal Republic of Germany for technical cooperation projects in 2007, and charged the Ministry of Foreign Affairs to effectuate the Exchange of Notes.
The Council of Ministers of B-H defined a Proposal Basis for negotiations for conclusion of an Agreement between Bosnia and Herzegovina and Brunei Darussalam on investment promotion and protection.
The proposer, Ministry of Foreign Trade and Economic Relations will provide the Proposal Basis to the Presidency of B-H for further procedure, and the Minister of Foreign Trade and Economic Relations of B-H is proposed as the B-H signatory of the Agreement.
The Council of Ministers of B-H defined a Proposal Basis for initiating procedure for B-H accession to the Agreement on International Classification of Figurative Elements of Seals.
The Proposer, Ministry of Foreign Trade and Economic Relations, will provide the Proposal basis to the Presidency of B-H for further procedure.
The Council of Ministers of B-H defined a Proposal Basis for conclusion of a Loan Agreement between Bosnia and Herzegovina, represented by the Ministry of Finance and Treasury of B-H, and UniCredit Bank Austria AG for Financing the Project of “Reconstruction and Extension of Gradiška Sewage System”.
The proposer, Ministry of Finance and Treasury, will provide the Proposal Basis to the Presidency of B-H for further procedure, and the Minister of Finance and Treasury of B-H is proposed as the signatory of the Agreement on behalf of B-H.
The Council of Ministers of B-H defined a Proposal Basis for conclusion of an Agreement between the Council of Ministers of B-H and Government of the Federal Republic of Germany on Financial Cooperation in 2009.
The proposer, Ministry of Finance and Treasury, will provide the Proposal Basis to the Presidency of B-H for further procedure, and the Minister of Finance and Treasury of B-H is proposed as the B-H signatory of the Agreement.
The Council of Ministers defined a Proposal Basis for conclusion of a Grant Contract between Bosnia and Herzegovina and the European Bank for Reconstruction and Development for Financing the Project of Operative and Technical Assistance for Implementation of the Law on Borrowing, Debt and Guarantees of Bosnia and Herzegovina.
The proposer, Ministry of Finance and Treasury, will provide the Proposal Basis to the Presidency of B-H for further procedure, and the Minister of Finance and Treasury of B-H is proposed as the signatory of the Agreement on behalf of B-H.
The Council of Ministers of B-H defined a Proposal Basis for conclusion of a Financing Agreement between Bosnia and Herzegovina and the Commission of European Communities for the 2010 State Cooperation Programme (Part I) under the Instrument of Pre-Accession Assistance.
The proposer, Ministry of Finance and Treasury, will provide the Proposal Basis to the Presidency of B-H for further procedure, and Head of the Directorate for European Integrations Nevenka Savić is proposed as the signatory of the Agreement on behalf of B-H.
The Council of Ministers of B-H defined a Proposal Basis for negotiations and conclusion of an Agreement between the Council of Ministers of Bosnia and Herzegovina and Government of the Republic of Cuba on Lifting Visas for Holders of Diplomatic and Service passports.
The proposer, Ministry of Foreign Affairs will provide the Proposal Basis to the Presidency of B-H for further procedure, and the Minister of Foreign Affairs is proposed as B-H signatory of the Agreement.
The Council of Ministers of B-H defined a Proposal Basis for negotiations and conclusion of an Agreement between the Council of Ministers of Bosnia and Herzegovina and Government of the Republic of Philippines on Lifting Visas for Holders of Diplomatic and Service passports.
The proposer, Ministry of Foreign Affairs will provide the Proposal Basis to the Presidency of B-H for further procedure, and the Minister of Foreign Affairs is proposed as B-H signatory of the Agreement.
The Council of Ministers of B-H considered and accepted an Initiative for negotiations and conclusion of a Loan Agreement between Bosnia and Herzegovina, represented by the Ministry of Finance and Treasury, and UniCredit Bank Austria AG for “Procurement of Utility Vehicles for the ‘Public Utility Company RAD Sarajevo’”, under the Framework Agreement and its accompanying Amendments between Bosnia and Herzegovina and the Republic of Austria.
For that purpose, the following delegation members are appointed:
- Minister of Finance and Treasury of B-H, or authorised persons – head of the negotiating team;
- Minister of Finance of B-H, or authorised persons;
- Minister of Finance of Sarajevo Canton or authorised persons; and
- Manager of the Public Utility Company “RAD”, or authorised persons.
Following a completion of negotiations, the Ministry of Finance and Treasury will act pursuant to the Article 39 paragraph 4 of the Law on Borrowing, Debt and Guarantees of Bosnia and Herzegovina (“Official Gazette of B-H”, No. 52/05), and will provide a Draft Loan Agreement and Basis for conclusion of the Agreement to the Council of Ministers.
The Council of Ministers of B-H is informed of a Decision of the Constitutional Court of Bosnia and Herzegovina on Admissibility and Merits No. AP.16/08 of July 21, 2010.
In that regard, the Ministry of Finance and Treasury is charged to implement the Decision-related the obligations of the Council of Ministers, taking care of the deadline for reporting to the Constitutional court of the measures undertaken.
Upon a proposal by the Ministry for Human Rights and Refugees, the Council of Ministers of B-H took a Decision on Amendments and Supplements of the Decision on Allocation of Budget Funds B-H for Addressing the Issue of Employment, Housing and Health Care of Roma.
Upon a proposal by the Ministry for Human Rights and Refugees, the Council of Ministers of B-H adopted the following Decisions:
- Decision on Amendment of the Decision on Setting-Up Monitoring Committee for Correctional Institutions (Prisons, Detention and Juvenile Detention Facilities), Police Stations and Psychiatric Institutions, confining persons deprived of their freedom against their own will;
- Decision on Amendment of the Decision on Setting-Up Monitoring Committee for Residential Facilities Accommodating Child Victims of Violence, Trafficking with People, Asylum Seekers, Illegal Immigrants, Refugees, Foreigners, Disabled Persons, and Other Institutions as Appropriate.
Upon a proposal by the Ministry of Civil Affairs, the Council of Ministers of B-H took a Decision to grant its consent for signing the Annex 8 to the Protocol on Co-Financing Mine Action Centre (MAC) Structures in Bosnia and Herzegovina, of June 18, 2002.
Upon a proposal by the Ministry of Civil Affairs, the Council of Ministers of B-H took a Decision on level of the cash part of the Sports State Award in Bosnia and Herzegovina and on presentation of Acknowledgements for 2010.
Under this Decision, the cash value of the first prize is KM 10,000.00, second prize is KM 6,000.00, and third prize is KM 4,000.00.
Upon a proposal of the Ministry of Foreign Trade and Economic Relations, the Council of Ministers of B-H took a Decision on Amendment on the Decision on Ban of Registration, Import and Trade with Active Matters and Phyto-Pharmaceutical Agents Containing Active Matters That Are Forbidden for Use in the EU.
Upon a proposal by the B-H Agency for Food Security, the Council of Ministers took a Decision to Set-Up Committee for Recognition of Natural Mineral and Natural Spring Waters in Bosnia and Herzegovina.
The Council of Ministers of B-H took a Decision on a Change of Legal Status of a Part of Property Disposed of the Security-Intelligence Agency of Bosnia and Herzegovina.
Upon a proposal by the Ministry of Finance and Treasury, the Council of Ministers of B-H took a Decision on Procedures for Carrying out Rights for Reimbursement during Maternity Leave in the Institutions of Bosnia and Herzegovina.
The Council of Ministers of B-H took a Decision on Approval of the Allocation of 2010 B-H Budget Reserve Funds and on Approval of Expenditures Structure for the Agency for Prevention and Coordination of Fight against Corruption.
The Council of Ministers took a Decision on Appointment of President of the Competition Council of Bosnia and Herzegovina, appointing member of the Competition Council dr. Stjepo Pranjic for president for a one year term.
The Council of Ministers of B-H considered and adopted a Report of the Ministry of Security on identified problems in application of special investigative actions in Bosnia and Herzegovina.
In that regard, the Ministry of Security is charged to develop a proposal decision on work group, to be comprised of representatives of authorised institutions of B-H, to prepare adequate methodologies and solutions to the problems identified in the area of application of special investigative actions.
The Council of Ministers of B-H considered and adopted a Report from the Ministry of Security on participation of Bosnia and Herzegovina in the international protection and rescue exercise “Armenia 2010”.
In that regard, the Ministry of Security is in charge to implement all the activities needed for the participation at the next NATO-organised protection and rescue exercise.
The Council of Ministers of B-H considered and adopted a Report from the Ministry of Defence on filled Questionnaire for Full PfP Interoperability 2010 (PfP, Planning and Review Process-PARP) and on the adopted partnership goals of B-H.
In that regard, the Ministry of Defence, Ministry of Security, NATO Coordination Team of the Council of Ministers and other sector Ministries are in charge to develop an Action Plan of Implementation of Partnership Goals and to undertake required measures for the implementation of PARP Programme obligations.
The Council of Ministers of B-H considered and adopted a Report from the Ministry of Defence on Joining B-H Ministry of Defence funds into the NATO Trust Fund for the 2010-2012 Project of Care for the Personnel of the Armed Forces of Bosnia and Herzegovina Realised from Duty, and concluded the following:
- The financial construction of the Project of Care for Personnel of the Armed Forces of B-H Released from Duty through NATO Trust Fund is accepted, and for the beginning of the project implementation, the budget of the Ministry of Defence should be restructured to allow for a transfer of KM 1,000,000.00 to current grants, and the Ministry of Finance and Treasury should make funds transfer to NATO Trust Fund account to be opened for this Project. The remaining funds to be joined to NATO Trust Fund in amount of KM 2,000,000.00 will be provided for in the B-H Budget in amount of KM 1,000,000.00 for year 2011 and KM 1,000,000.00 for year 2012.
Simultaneously with the adoption of the Report, the Council of Ministers of B-H took a Decision on Joining Funds from the Ministry of Defence into NATO Trust Fund for the 2011-2012 Project of Care for Personnel of the Ministry of Defence (Armed Forces) Released from Duty.
The Council of Ministers of B-H considered and adopted a Report from the Ministry of Civil Affairs on implementation of the Framework Legislation on Preschool Education in Bosnia and Herzegovina, and concluded the following:
- The Council of Ministers assessed that the obligation of harmonisation and adoption of Entity legislation on secondary professional education based on the Framework legislations is not fully or timely accomplished;
- The Council of Ministers urges the competent education authorities to invest additional efforts to meet their obligations prescribed by the Framework Legislation;
- The Council of Ministers expect the Agency for Preschool, Primary and Secondary Education to accelerate the process of fulfilment of all its obligations stemming from the Law.
The council of Ministers considered and adopted Information of the Ministry of Civil Affairs on Implementation of the Framework Law on Secondary Professional Education and Training in Bosnia and Herzegovina, and in that regard, it concluded the following:
- The Council of Ministers assesses that an obligation of harmonisation and enacting its own legislation on secondary professional education, based on the Framework Law, is not fully accomplished within the defined deadline;
- The Council of Ministers urges the competent education authorities to invest additional efforts to fulfil their obligations stemming from the Framework Law;
- The Council of Ministers expects the Agency for Preschool, Primary and Secondary Education to accelerate the process of fulfilment of its obligations from the Framework Law.
The Council of Ministers of B-H considered and adopted a Report from the B-H Agency for Food Security on Risk Assessment and Analysis of Food in Bosnia and Herzegovina for the period of January 1 – June 30, 2010, and adopted the following conclusions:
- Evidence based on data collected and processed by public health institutions indicate that the number of cases of sickness caused/transmitted by food in 2010 has dropped in comparison to the same period in 2009;
- The collected and processed data from food control laboratories indicate that in the first six months of 2010 the number of unfavourable laboratory results of food has dropped in comparison to 2009;
- The B-H Agency for Food Security is charged to continue an active coordination of risk assessment and analysis of food, together with competent bodies of B-H, Entity and Brčko District, with an aim to protect health of people and animals and to ensure an equal market treatment for domestic food producers.
- The B-H Agency for Food Security, as a contact point, is charged to continue its cooperation through a quick data exchange within early warning systems concerning human and animal food, namely INFOSAN and RASFF systems;
- All B-H, Entity and Brčko District institutions, especially food control laboratories, public health institutions and competent inspection bodies, are charged to continue with a regular provision of data to the B-H Agency for Food Security;
- The B-H Agency for Food Security is in charge to provide recommendations, based on data collected and processed, on food-related risk assessment and analysis to B-H legislative bodies and public.
The Council of Ministers of B-H received information from the Directorate for Economic Planning on macroeconomic trends for the period January-August 2010.
The Council of Ministers of B-H considered and adopted a Report from the Ministry of Foreign Trade and Economic Relations on the “Protection and Sustainable Utilisation of Cross-Border Dinaric Karsts Aquifer System” (DIKTAS) Project.
Simultaneously, the Council of Ministers accepted a Project Document for “Protection and Sustainable Utilisation of Cross-Border Dinaric Karsts Aquifer System” (DIKTAS) and appointed Mladen Zirojević Minister of Foreign Trade and Economic Relations as the Project Document signatory on behalf of B-H.
The Council of Ministers of B-H considered and adopted information from the Directorate for European Integrations on a proposed multi-year indicative plan document (MIDP) for 2011-2013.
In that regard, the Directorate for European Integrations of B-H is charged to ensure that the commentaries to the 2011-2013 MIPD, presented in the form of conclusions to Information, should be adopted during the continuation of a dialogue with the European Commission.
The Council of Ministers of B-H considered and adopted the Second Periodic Report of Bosnia and Herzegovina on Application of the International Treaty on Civic and Political Rights.
The Ministry for Human Rights and Refugees is charged to submit timely the Report to the UN Committee for Human Rights in Geneva.
The Council of Ministers of B-H considered and adopted a Report from the Ministry of Justice on implementation of Regulations on Consultations for Legal Regulations Development in B-H Institutions, and in that regard adopted the following conclusions:
- All B-H institutions are obliged to provide for, in their 2011 work programmes, establishment of required instruments for application of the Regulations on Consultations for Legal Regulations Development in B-H Institutions (appoint consultations coordinator, prepare a list of OCDs and individuals interested for consultations, assess regulations’ impact to general public, and determine a form of regulations development consultations envisioned under 2011 institutions’ work programme, assess a financial impact of consultations implementation, publish a list of normative-legal operations under the 2011 work programme on their websites and deliver it to listed agencies and individuals and to all those who request it in written).
- Managers of the B-H institutions will direct their staff on the importance of implementation of the Regulations on Consultations and task them for the implementation;
- The Ministry of Justice is charged to develop, in the course of 2011, a methodology of commentaries submission applicable in all B-H Institutions;
- Following the example of the Ministry of Justice, all B-H Institutions will develop, in the course of 2011, their internal procedures, specifying the implementation of the regulations on consultations:
- The Council of Ministers of B-H will define more specifically the obligation of implementation of the Regulations on Consultations, in 2011, though amendments and supplements to its Rules of Procedure, and the Secretariat General of the Council of Ministers of B-H is responsible to carry out this activity;
- The Ministry of Justice is charged to report annually the Council of Ministers of B-H on the implementation of the Regulations on Consultations, providing all data on implementation of previous conclusions of the Council of Ministers of B-H.
The Council of Ministers is informed of the supplemented Report of the Ministry for Human Rights and Refugees on realisation of the Action Plan for Solving the Issues of Employment, Housing and Heath Care of the Roma Population in 2009.
The Ministry for Human Rights and Refugees is in charge to develop, in cooperation with competent Entity and Municipal bodies, effective and rational funds utilisation mechanisms allocated from B-H Budget for addressing the issues of the Roma population.
The Ministry for Human Rights and refugees is charged to deliver every six months to the Council of Ministers concise reports on the implementation of the Action Plan.
The council of Ministers reiterates a need for the overall Action Plan implementation process to include Roma NGOs and Associations.
The Council of Ministers of B-H adopted a report on EXPO 2010 - B-H Section.
The B-H Section for participation at EXPO 2010 Shanghai is in charge to deliver a detailed financial statement by December 31, 2010.
The Council of Ministers concluded that as at today, every payment out from the B-H Budget in favour of B-H Section at EXPO 2010 Shanghai ceases.
The Council of Ministers considered and adopted a report from the Ministry of Foreign Trade and Economic Relations on implementation of measures for improvement of conditions for agricultural and food procession business making in Bosnia and Herzegovina.
All institutions competent for implementation of the measures are in charge to up-date the Ministry of Foreign Trade and Economic Relations on implementation of measures for improvement of agricultural and food processing business making in Bosnia and Herzegovina.
The Council of Ministers considered and adopted a Report on realisation of the B-H Council of Ministers Work Programme for January-September 2010, and concluded the following:
- The Council of Ministers assesses the realisation of certain programme tasks as unsatisfactory, and demandes activity holders to take additional efforts to implement the programme obligations as early as possible;
- In tabular review of the realisation of the Work Programme of the Council of Ministers Work Programme, a programme task “Action Plan Concerning Persons with Disabilities ” is transferred to the Ministry of Civil Affairs (Thematic Part, Item No. 109);
- In tabular review of the realisation of the Work Programme of the Council of Ministers Work Programme, a programme task”Decision on Level of Reimbursements for Safety Licences for Workshops, Work Equipment and Parts of Mobile Capacities and Infrastructure“ (proposal by-regulations and other normative regulations, No.41 ) is deleted, as the Ministry of Transport and Communications of B-H, the proposer, indicated the reasons not to take this Decision.
The Council of Ministers of B-H is informed of “Economic Trends in Bosnia and Herzegovina in January-June 2010”, prepared by the Directorate for Economic Planning.
The Council of Ministers granted its consent to a specification of work posts for secondary level of education classified by salary levels of the B-H Institute for Accreditation.
The Council of Ministers also granted its consent, with an accompanying obligation that all the specifications should be brought into conformity with the Ministry of Finance and Treasury opinion, to work posts specifications for secondary level of education classified by salary levels of the following institutions:
- Mine Action Centre;
- Veterinary Office of B-H;
- Directorate for European Integrations;
- B-H Agency for Food Safety; and
- Directorate for Civil Aviation.
The Council of Ministers of B-H adopted a Conclusion on grating its consent for issuing a guarantee by Multilateral Investment Guarantee Agency (MIGA) for an investment by ProCredit Holding AG – ProCredit Bank d.d. Sarajevo.
The Council of Ministers of B-H defined a Proposal Agreement on Amendment of the Agreement on of Social Insurance between Bosnia and Herzegovina and the Republic of Slovenia.
The proposer, Ministry of Civil Affairs, will provide the Proposal Agreement to the Presidency of B-H for further procedure, and Minister of Civil Affairs Sredoje Nović is proposed as the signatory on behalf of B-H.
The Council of Ministers of B-H is informed of a request for visa issuance to Kosovo citizens for the purpose of participation at the Monitoring Study on Status of Electronic Communications and Information Society in Practice, to be held in Sarajevo, on November 4 and 5, 2010.
In that regard and in line with the Conclusion from the 86th session of the Council of Ministers, held on may 7, 2009, taken in relation to the position of the Presidency of B-H on legality of documents owned by Kosovo citizens, the Council of Ministers authorises the Ministry of Foreign Affairs to issue entry visas on a separate sheet for two persons from the list accompanying the relevant request, to take part at the Monitoring Study on Status of Electronic Communications and Information Society in Practice, in Sarajevo, on November 4 and 5, 2010, for the period of the Conference.
The Secretariat General of the Council of Ministers is in charge to provide the above conclusion to the Ministry of Foreign Affairs of B-H for further procedure.
The Council of Ministers of B-H is informed of a request for visa issuance to Kosovo citizens for the purpose of participation at the Trade Union Forum in Sarajevo, on November 9 and 10.
In that regard and in line with the Conclusion from the 86th session of the Council of Ministers, held on may 7, 2009, taken in relation to the position of the Presidency of B-H on legality of documents owned by Kosovo citizens, the Council of Ministers authorises the Ministry of Foreign Affairs to issue entry visas on a separate sheet for one person from the relevant request, to take part at the Trade Union Forum in Sarajevo, on November 9 and 10, for the period of the Forum.
The Secretariat General of the Council of Ministers is in charge to provide the above conclusion to the Ministry of Foreign Affairs of B-H for further procedure.
The Council of Ministers of B-H appointed Lenka Kozić as Director and Dražen Primorac as Deputy Director of the B-H Agency for Market Surveillance.
The Legislative Office is in charge to prepare the Decision on Appointment and submit it to the Chairman of the Council of Ministers for signature.
Upon a proposal by the Ministry of Transport and Communications, the Council of Ministers of B-H took a Decision on use of a part of surplus revenues of the B-H Communications Regulatory Agency in amount of KM 2,952,000 for financing of a part of Digitalisation of Microwave Connections of the B-H Public Broadcasting Service Project (procurement of radar for coverage with digital signal of East Sarajevo, Bijeljina, Brčko, Tuzla and Zenica, and for financing the Ratio-TV Radar System in Mostar area).
The Council of Ministers of B-H is informed of decisions taken on appeals in the competition procedure for selection of the managing civil servant - Secretary-General of the Council of Ministers of Bosnia and Herzegovina.
The Council of Ministers decided to propose to the B-H Agency for Civil Service the following two members of the Competition Committee to implement the complete procedure of the selection together with applicants from the Secretariat-general:
- Dobrivoje Jovičić
- Slobodanka Avdagić.
The Council of Ministers requested the Appeals Committee of the B-H Agency for Civil Service to provide data on legal grounds for this body on taking decision to form a new Competition Committee for selection of the Secretary-General of the Council of Ministers of Bosnia and Herzegovina, despite a clear provision of Article 31 paragraph 4 of the Decision on Taking Public and Professional Exam, which provides explicitly that Committee members are independent and that certain scores given by certain Committee members neither can constitute a basis for appeal nor can be challenged in the procedure applying a legal remedy.
The Council of Ministers charged the Ministry of Transport and Communications and Ministry of Finance and Treasury to implement obligations stemming from a Decision on use of a part of revenue surplus over expenditures of the B-H Regulatory Communications Agency (No. 202/10, published in the Official Gazette of B-H), in order to avoid payment of interest on the contracted amount.
