Council of Ministers of Bosnia and Herzegovina Holds Its 26th Session

The Council of Ministers of BIH adopted an Action Plan for the Reform Agenda implementation at the level of the Council of Ministers of Bosnia and Herzegovina, which consists of a package of measures to be implemented solely by the BIH Institutions or in cooperation with the Entities in years 2015 and 2016.
The Action Plan envisages more than 50 measures for implementation in the areas of public finances, taxation and fiscal sustainability, business climate and competitiveness, rule of law and good management, and public administration reform.
BIH PREPARES 2016-2018 ECONOMIC REFORMS PORGRAMME
The Council of Ministers of BIH adopted Information of the Directorate for Economic Planning on preparation of the 2016-2018 Economic Reforms Programme in BIH, which should be submitted to the European Commission by January 2016, at latest.
The economic reform programme, currently under preparation of the BIH authorities,contain mid-term macro-economic and fiscal policy framework, including fiscal measures, and on the other side, it consists of comprehensive structural reforms measures aimed to improve growth and competitiveness.
TO ENSURE FAVOURABLE APPARTMENTS PURCHASE FOR YOPUTH
The Council of Ministers of BIH defined a proposal Framework Loan Agreement between the Development Bank of the Council of Europe (CEB) and Bosnia and Herzegovina LD 1836 (2014) – BIH Social Housing Programme Loan, in RepublikaSrpska, administered by the IRBRS, with basics for its conclusion.
The EUR 5 million worth loan will be used for financial assistance in housing for groups of particular importance for BIH, primarily young and highly educated people.
This way, youth and highly educated citizens in RepublikaSrpska will be facilitated to attain immobility ownership by way of loan, which would improve living conditions and would encourage young people to create their families and highly educated people to stay in Bosnia and Herzegovina.
The Ministry of Finance and Treasury will provide the proposal Framework Loan Agreement, with basics for its conclusion, to the BIH Presidency for further procedure, and Minister VjekoslavBevanda was proposed for the signatory.
ACCOMMODATION FOR TEN BIH INSTITUTIONS
The Council of Ministers of BIH took a decision, upon a proposal of the Ministry of Finance and Treasury, to approve KM 441,000.00 from the budget current reserves.
The funds are intended for payment of rentals for 10 Institutions of Bosnia and Herzegovina, supposed to move, on April 1, 2015, to a building in 9 a MaršalaTita St., as well as in the building in East Sarajevo, and which will not be possible due to delays in reconstruction of the building, carried out by a developer chosen by the General Affairs Service of the BIH Institutions, and due to objections by two institutions to move to this building in East Sarajevo, and which is under consideration currently. The deadline, September 1, 2015, for moving was prolonged.
Also, under a decision of the Council for State Aid, KM 66.328.00 from the budget current reserves will be approved for solving the status issues, and because of unpaid funs from Republika Srpska, by which this institution is financed in one third share, in addition ot funds from the Council of Ministers of BIH and Government of the Federation of BIH. The Council of BIH will, in accordance with the Law on State Aid System request form Republika Srpska to refund the expenses.
Simultaneously, the Veterinary Office got, under the same decision, KM 21,500.00 for the rest of the year for hiring three civil servants and two employees at defined assignments of the Office and for improvement of its efficacy.
TO HARMONISE LABOUR AND PENSION REGULATIONS OF BIH
The Council of Ministers of BIH adopted Information of the Ministry of Civil Affairs on disharmony of regulations in Bosnia and Herzegovina in the area of labour and pension rights.
The Council of Ministers of Bosnia and Herzegovina, in accordance to a recommendation of the Institution of Ombudsman for Human Rights of Bosnia and Herzegovina, of March 26, 2015, calls upon all relevant bodies at all levels to take all activities needed for implementation of the Ombudsman’s decision.
The Ministry of Civil Affairs will provide this information with recommendation of the Ombudsman to all competent institutions.
The issues appeared due to different defining of legal provisions in regard to attaining right for age pension, not only for police officers, but also for other categories of employees which working period is calculated as if of a longer duration.
RATIFICATION OF BORDER TREATY WITH MONTENEGRO
The Council of Ministers of BIH, upon a proposal of the Ministry of Foreign Affairs, defined a proposal Decision on ratification of a treaty on State Border between Bosnia and Herzegovina and Montenegro, which will be provided to the BIH Presidency for further ratification procedure. Thus, a procedure for defining the state border between the two neighbouring countries will be finalised, which is an important breakthrough in the region.
TO IMPROVE SINGLE RULES FOR DEVELOPMENT OF LEGAL REGULATIONS
The Council of Ministers of BIH adopted and will forward to the Parliamentarian Assembly of BIH a Report of the Ministry of Justice on application of single rules for development of legal regulations in the Institutions of Bosnia and Herzegovina, which provides a review of establishment and implementation of a system for development of regulations at the BIH level, with a proposal measures for the process up-grading.
The session concluded that the Single Rules, although providing a solid framework for development of high quality regulations, needs to be additionally up-graded, which is the responsibility of the Ministry of Justices and the Council of Ministers Legislation Office.
All Ministries and other institutions are tasked to start establishing specialised units, without additional staff hiring, for normative-legal operations with the Ministries having a broader volume of such tasks, while the other Ministries and BIH institutions would have specialised officers to undergo a special training.
The competent institutions of BIH are tasked to develop software for regulations development, which will be a specialised version of the “word” programme, use of IT system for official dispatch of draft regulations, explanation of opinions, as well as data base search on legislation, including court awards, various readings and EU legal resources.
The Ministry of Justice is tasked to report annually to the Council of Ministers and Parliamentarian Assembly of BIH on application of Single Rules, which would include report on implementation o previous conclusions of the Council of Ministers of BIH and BIH Parliamentarian Assembly.
PROCEDURE LAUNCHED FOR APPOINTMET OF COMMITTEE FOR REFUGEES AND DISPACED PERSONS
The Council of Ministers, upon a proposal of the Ministry for Human Rights and Refugees, granted its consent for appointment of members of a Committee for Refugees and Displaced Persons, on behalf of the Council of Ministers of BIH, namely, for Minister for Human Rights and Refugees Semiha Borovac, Deputy Minister Predrag Jovović, Head of Office of Deputy Minister for Human Rights and Refugees Milenko Tošić, as well as for Damir Ljubić.
The Council of Ministers of BIH urges the Heads of Missions of UNHCR, OHR and OSCE to delegate their representatives, as observers into the Committee for Refugees and Displaced Persons of BIH,
Names o the proposed members on behalf of the Council of Ministers of BIH will be provided to the BIH Presidency for further procedure.
The BIH Presidency and Entity Governments and Brčko District Government proposed their representatives, too.
CoMBIH ENDORSED APPOINMENT FO DRAGAN PRUSINA FOR MANAGER OF OFFICIAL GAZETTE
The Council of Ministers of BIH endorsed, upon a proposal of the Ministry of Justice, a Decision on Appointment of Dragan Prusina for Manager of the Public Company Official Gazette of Bosnia and Herzegovina for a four-yea term.
The vacancy procedure for appointment of Manager of the Public Journal-Publishing Company Official Gazette of BIH, based on a decision of the Steering Board, of July 22, 2014, was published in official heralds of BIH, Entities and BRlko District, as well aa in Dnevni Avaz anf Nezavisne Novine daily papers. Total three candidates applied, and following the appropriate procedure including interviews with candidates, the Steering Board, upon a proposal of Vacation Procedure Board, took the decision for appoint Dragan Prusina for Manager.
