Council of Ministers of Bosnia and Herzegovina Holds Its 150th Session

The proposer, Ministry of Defence, will provide the Proposal Agreement to the Presidency of B-H for further procedure, and the Minister of Defence is proposed as B-H signatory.
The Council of Ministers of B-H defined a Proposal Agreement between Bosnia and Herzegovina and the Government of the Republic of Indonesia on non-visa regime for holders of diplomatic and service passports, and adopted a Report from negotiations.
The proposer, Ministry of Foreign Affairs, will provide the Proposal Agreement to the Presidency of B-H for further procedure, and the Minister of Foreign Affairs is proposed as B-H signatory.
The Council of Ministers of B-H considered proposed contracts with the Public Company B&H Airlines Sarajevo Ltd. on evacuation of B-H citizens from riots-ravaged Libya.
In regard to that, the Ministry of Foreign Affairs is tasked to attach to each contract a rationale concerning the level and source of needed finances, based on which the Ministry of Finance and Treasury will issue its opinion concerning financial aspects of the proposed documents.
The Council of Ministers of B-H defined a Proposal Basics for conclusion of an Agreement on Loan, Financing and Project between the KfW , Frankfurt am Main, and Bosnia and Herzegovina, represented by the Ministry of Finance and Treasury (Borrower), Federation Bosnia and Herzegovina, represented by the Federal Ministry of Finance, Republika Srpska, represented by the Ministry of Finance of Republika Srpska, Public Company Elektroprivreda BiH JSC Sarajevo (EP BiH), Public Company Elektroprivreda Hrvatske Zajednice Herceg-Bosne JSC Mostar (EP HZHB), and Public Company Elektroprivreda Republike Sprske JSC Trebinje (EP RS) for EUR 17 million - SCADA/DMOS/OMS at the distribution level.
The proposer, Ministry of Finance and Treasury, will provide the Proposal Agreement to the Presidency of B-H for further procedure, and the Minister of Finance and Treasury is proposed as B-H signatory.
The Council of Ministers of B-H defined Proposal Decisions on ratification of international treaties, as follows:
- Proposal Decision on Ratification on a Loan Agreement for Financing Procurement of Equipment for the RAD Public Utility Company, Sarajevo, between Bosnia and Herzegovina, represented by the Ministry of Finance and Treasury, and UniCredit Bank Austria AG; and
- Proposal Decision on Ratification of an Agreement between the Council of Ministers of Bosnia and Herzegovina and Government of the Republic of Croatia on Transfer and Admission of Persons Whose Entrance or Stay Is Illegal, and Protocol between the Ministry of Security of Bosnia and Herzegovina and Ministry of Interior of the Republic of Croatia on Transfer and Admission of Persons Whose Entrance or Stay Is Illegal.
The proposer, Ministry of Security will provide the Proposal Decisions to the Presidency of B-H for adoption.
The Council of Ministers of B-H considered and adopted Information of the Ministry of Foreign Trade and Economic Relations concerning the development of Regulations on Criteria for Issuance of Licences of Internal and Foreign Trade with Arms and Military Equipment, with the following conclusions:
- It accepts an Amendment to the Directions on Conditions and Procedures for Issuance of Licences for Foreign Trade with Goods and Services of Strategic Importance for Security in Bosnia and Herzegovina, No. 07-1-02-785/10, of March 2, 2010, in Article 4 after paragraph (7), a new paragraph (8) is added: “The Ministry of Foreign Trade and Economic Relations of Bosnia and Herzegovina submits to the Intelligence-Security Agency of Bosnia and Herzegovina a request for security check for all participants in trade, referred to in paragraphs (1) and (5) above. If the Intelligence-Security Agency of Bosnia and Herzegovina possesses knowledge of security obstacles, it will present its opinion to the Ministry of Foreign Trade and Economic Relations of Bosnia and Herzegovina within 60 days“;
- The Minister of Foreign Trade and Economic Relations will take a decision to form a steering team for extraordinary supervision, pursuant to provisions of the relevant legal regulation in force – Direction on Supervision over Natural and Legal Persons Who Are Issued Licence or Registered for Foreign Trade with Goods from Control Lists (“Official Gazette of B-H”, No. 28/10);
- Cooperation between agencies of all institutions taking part in foreign trade with armament and military equipment should be enhanced, including staff training, while the institutions responsible for issuance of licences for export of armament and military equipment should check the competence of staff engaged in these activities, also initiating their change in case of spotted irregularities.
Upon a proposal of the Ministry of Transport and Communications, the Council of Ministers of B-H took a decision on fee reimbursements level for licences, permits and security confirmations issuance by the Regulatory Board of Railways of Bosnia and Herzegovina.
Upon a proposal of the Public Procurement Agency, the Council of Ministers of B-H adopted a Direction on Information in Public Procurement Procedures, with a proposed amendment of Article 10 of the Direction to take effect on Sep. 1, 2011.
The Council of Ministers of B-H postponed coming out on a Proposal Decision on Granting Consent to a Study on application of methodology for classifying working posts of secondary education level into payment categories as defend by the Law on Salaries and Reimbursements in Institutions of Bosnia and Herzegovina.
Upon a proposal of the Ministry of Civil Affairs, the Council of Ministers of B-H took a Decision on Status of Equipment, Inventory and Other Objects, Resources, Archives and Documentation, Official Premises and Employees of the Health Care Institute of Bosnia and Herzegovina.
Upon a proposal of the Ministry of Civil Affairs, the Council of Ministers of B-H took a Decision on Status of Equipment, Inventory, Resources, Official Premises and Employees of the Administration for Geodetic and Property Affairs of Bosnia and Herzegovina.
Upon a proposal of the Commission for Suppression of Misuse of Narcotics, the Council of Ministers took a Decision on Supplementing the List of Psychotropic Substances and Herbs Used for Production of Narcotics and Precursors.
Upon a proposal of the Ministry of Security, the Council of Ministers took a Decision on Amendment of the Decision Establishing the State Commission for Integrated B-H Border Management, appointing the following members of the Commission:
- Radenko Radović, representative of the Administration for Health of Herbs;
- Mladen Goluža, representative of the Ministry of Transport and Communications; and
- Edvin Alibašić, representative of the Indirect Taxation Administration.
The Ministry of Security is in charge to unify the decisions on appointment into a single text.
The Council of Ministers of B-H did not come out on a proposal Decision on Authorisation of Agency of Identification Documents, Evidence and Data Exchange of B-H for development of border documents.
The Council of Ministers of B-H considered and adopted Information of the Ministry of Finance and Treasury concerning the implementation of a Contract on Rescheduling of Obligations of Replenishing of Counter-Value Fund subject to Exchanged Notes with the Government of Japan, in the period from 1996 to 200, conclusive at Dec. 31, 2010, with the proposed conclusions.
The Council of Ministers of B-H did not come out on April 22, 2011 Information of the Ministry of Security on Monitoring of implementation of Decision on Non-Visa Regime for Citizens of Bosnia and Herzegovina travelling to the EU.
The Council of Ministers of B-H considered and adopted Information of the State Commission for Integrated Border Management in B-H on activities concerning bilateral international contracts governing the status of border crossings with the Republic of Croatia, with the proposed conclusions.
In regard to that, competent institutions of B-H are tasked to prepare information, for the needs of the State Commission for Integrated Border Management, on a possibility for setting-up an additional BIP (Border Inspection Post) at the border crossing Izačić – Lično Petrovo Selo and its categorisation, i.e. a kind of goods subject to inspection controls that would be transported through this border crossing and further exported to the EU market.
The competent institutions of Bosnia and Herzegovina are tasked to prepare proposals, for the needs of the State Commission for Integrated Border Management, of locations and categories of border crossings for goods - to be exported to EU - subject to phytosanitary controls.
The competent institutions of B-H are in charge to undertake ala activities to make the border crossings Bijača and Gradiška functional in accordance with agreements reached with representatives of the Republic of Croatia.
The State Commission for Integrated Border Management is in charge to report to the Council of Ministers of B-H all activities related to bilateral international contracts governing border crossings with the Republic of Croatia.
The Council of Ministers considered and adopted an Individual Plan for Partnership between B-H and NATO for 2001-2013, and Individual partnership Programme for 2011.
In regard to that, The Ministry of Foreign Affairs is in charge to provide these docuemnts to the Presidency of B-H for further procedure.
The Council of Ministers considered and adopted Activity Reports for 2010 ad Work programme for 2011 as follows:
- Activity Report of the Council of Sports of B-h for the period from April 28, 2009 to December 31, 2010;
- Activity Report of the Inter-sector Work Group for Monitoring of Implementation of the “Security Policy of Bosnia and Herzegovina” in 2010 and its Work Programme for 2011.
The Council of Ministers considered and adopted a Report of the Ministry of Foreign Trade and Economic Relations on Realisation of a Road Map implementation, aimed at creation of conditions for export of products of animal and herbal origin.
The Council of Ministers of B-H granted its consent to Representative of the Council of Ministers before the European Court for Human Rights to sign and deliver to the European Court for Human Rights, on behalf of Bosnia and Herzegovina, a Unilateral Declaration in view of applicant Muratspahić in the file Muratspahić and others vs. Bosnia and Herzegovina, app.no. 41925/06.
The Council of Ministers of B-H granted its consent to Representative of the Council of Ministers before the European Court for Human Rights to sign and deliver to the European Court for Human Rights, on behalf of Bosnia and Herzegovina, a Unilateral Declaration in the file Momić and 83 others vs. Bosnia and Herzegovina, for the following applications:
- Bajić vs. B-H, app.no. 47643/08;
- Božić vs. B-H, app.no. 11373/07;
- Kaurin vs. B-H, app.no. 37147/09; and
- Kaurin vs. B-H, app.no. 14172/07.
Upon a proposal of the Ministry of Foreign Affairs, the Council of Ministers of B-H took a Decision on Appointment of prof. Danilo Kapas as Honorary Consul of the Republic of Italy in Bosnia and Herzegovina and on granting its consent to the opening of the Honorary Consulate Office of the Republic of Italy Office in Bosnia and Herzegovina, with the seat in Banja Luka.
The Council of Ministers of B-H is informed of an application form for visa issuance for holders of Kosovo travel documents for their participation at the Regional Conference on Support of the Kingdom of Sweden in Cooperation in Western Balkans Reforms, to be held in Sarajevo on September 12-16, 2011.
In regard to that, and in compliance with the Conclusion from the 86th session of the Council of Ministers of May 7, 2009, taken in connection with a Position of the Presidency of B-H on the issue of legality of documents in possession of Kosovo citizens, the Council of Ministers authorises the Ministry of Foreign Affairs to issue entry visas at a separate sheet for two members Kosovo delegation, as indicated in the application, for their participation at the Conference, to be held on Septembeer12-16, 2011, for the period of the Conference.
The Secretariat General of the Council of Ministers is in charge to deliver the conclusion to the Ministry of Foreign Affairs for further procedure.
The Council of Ministers of B-H is informed of an application form for visa issuance for holders of Kosovo travel documents for their participation at the Second Regional Conference of SEE Union of Metal Workers and on Second Regional Women Section of the Union of Metal Workers, to be held on May 12.-16, 2011.
In regard to that, and in compliance with the Conclusion from the 86th session of the Council of Ministers of May 7, 2009, taken in connection with a Position of the Presidency of B-H on the issue of legality of documents in possession of Kosovo citizens, the Council of Ministers authorises the Ministry of Foreign Affairs to issue entry visas at a separate sheet for all members of the delegation, indicated in the application, for their participation at the Conference, to be held on may 12-16, 2011 for the period of the Conference.
The Secretariat General of the Council of Ministers is in charge to deliver the conclusion to the Ministry of Foreign Affairs for further procedure.
The Council of Ministers of B-H adopted Information of the General Affairs Service of Institutions of Bosnia and Herzegovina, with a proposal to grant its consent to the General Affairs Service for signing of a power supply consent and contract with the Power Distribution Company on power supply services for the needs of B-H Institutions situated in 39 Džemala Bijedića Street in Sarajevo.
In regard to that, the General Affairs Service of B-H Institutions is in charge to sign an application for issuance of consent for power supply for connection to power distribution grid of a part of business centre in 39/II Džemala Bijedića Street in Sarajevo, of total surface of 1,267.60 m2, used by B-H institutions, and to sign, in its capacity of a end user, a contract with Power Distribution Company.
