Council of Ministers of BIH in Extraordinary Session Defines Proposal Law on Amendments and Supplements to Criminal Code of Bosnia and Herzegovina

The Council of Ministers of BIH defined a proposal Law on Amendments and Supplements to the Criminal code of Bosnia and Herzegovina, aiming harmonisation of criminal legislation of BIH with international law and compliance with recommendations of GRECO, MONEYVAL Committee and FATF, international agencies for control and prevention of money laundering and financing of terrorism. 

The Proposal Law separates competences for certain criminal acts included the criminal legislation of BIH, Entities and Brčko District of BIH, in order to remove risks from overlapping of competences between their respective police and judiciary bodies.

Amendments and Supplements to the Criminal Code set forth, among other things, stricter sanctions for criminal acts of human trafficking, classify organised international human trafficking as a separate criminal act, and introduce a new criminal act “faceable disappearance”. Also a new obligation was introduced of seizure of material benefit originating from criminal activity, also from the persons the property was transferred to, while the law regulates precisely all actions and failures made in exercise of duties by officers.

The Amendments and Supplements to the Law were reviewed and endorsed by a Team for Monitoring and Assessment of Criminal Legislation Enforcement, comprised of experts in criminal law from all BIH.

The Ministry of Justice will provide the Proposal Law to the Parliamentarian Assembly of BIH for adoption under urgent procedure.
