SUPPLEEMENTS TO LAW ON OFFENCES DEFINED 

The Council of Ministers of BIH defined and will forward to parliamentarian procedure a Draft Law  on Supplements to the Law on Offences,  under which a possibility is provided for payment of a half of fee imposed by issuing offence order, thereby harmonising this area with Entity regulations and setting-up an uniform procedure in BIH.

According to Supplements to the Law, as proposed by the Ministry of Justice, id a person receiving a payment order pays the fine within eight day-deadline, it is freed from paying the rest of payment in amount of 50%.

Simultaneously, the Supplements authorises the Indirect taxation Administration to make forcible collection of fines imposed not only under offence orders of authorised  Administration officers , but also under court awards resulting from offence order issued by the Indirect Taxation Administration.

 

DIGITALISATION ISSUE TO BE SOLVED URGENTLY

 

The Council of Ministers of BIH took note of a conclusion from the 5th session of the Joint Collegium of both Chambers of the Parliamentarian Assembly of BIH and from 13th session of the Collegium of the BIH Parliamentarian Assembly House of Representatives on topical issues and challenges in the digitalisation process.

The Ministry of Communications and Transport and Communications Regulatory Agency of BIH are tasked to find systematic solutions as soon as possible in order to accelerate the digitalisation process.

 

FOSTERED BIH-SERBIA COOPERATION IN EU ACCESSION PROCESS

 

The Council of Ministers of BIH defined a Proposal Memorandum on technical cooperation in agriculture between the Ministry of Foreign Trade and Economic Relations of Bosnia and Hercegovina and Ministry of Agriculture and Environmental Protection of the Republic of Serbia, which strengthens cooperation in the process of accession to the European Union.

The subject of the Memorandum is intensified cooperation in sectors of food safety, veterinary, phytosanitary protection, agriculture and rural development in the process of harmonisation of legislation with the EU acquis, as well as exchange of experiences as to use of pre-accession EU funds for rural development.

The Ministry of Foreign Trade and Economic Relations will provide the Proposal Memorandum with a negotiations report to the BIH Presidency, and Minister Mirko Šarović was proposed for the BIH signatory.

 

TO DECRESE DRUGS TRANSPORT COSTS

 

The Council of Ministers of BIH, upon a proposal of the Ministry of Security, took a decision on amendment and supplements to the decision on defining international border crossings for cross-border transport of maters and herbs from tables II, III and IV of the list of narcotics, psychotropic agents and herbs, from which it is possible to derive narcotics and precursors.

For the purpose of decreasing the costs of drugs transport in BIH, and with earlier identification of cross borders, two additional cross borders are included, namely, Vardište and Šamac, as border crossings for cross-border transport of maters and herbs identified in the list of narcotics, psychotropic matters, herbs form which iit is possible to derive narcotics and precursors.

 

STIPULATIONS ON PUBLIC PROCUREMENT FOR HARMONSATION WITH EU ACQUIS

 

The Council of Ministers of BIH, upon a proposal of the BIH Public Procurement Agency, took a Decision on use of a single public procurement terminology for the needs of gradual harmonisation of relevant regulations  with the EU legislation and implementation of the Public Procurement Law.

A Single Public Procurement Dictionary is an integral part of the decision and is accessory for unified definition of public procurement items.

 

JOINT PRIOCUREMENT FOR FINANCIAL SAVINGS

 

The Council of Ministers of BIH, upon a proposal of the BUH Public Procurement Agency, took a Regulation on implementation of a joint public procurement procedure and establishment of a Central Procurement Body for the needs of multiple contracting parties deciding for a joint public procurement procedure for the reason of financial savings.

 

IMPROVED PUBLIC PROCUREMENT TRANSPARENCY

 

For the purpose of improved transparency of public procurement, The Council of Ministers of BIH took a Regulation on publication of basic elements of contracts and related amendments, as proposed by the BIH Public procurement Agency.

According to Instructions, a contracting body, after filling a public procurement report the BIH Public Procurement Agency, is obliged to publish on its web site the basic elements of relevant pubic procurement contract and all its amendments made in the process of implementation. The aim is to enable a public insight of contract implementation in the public procurement process.

 

BIH ISNTITUTIONS OBLIGED TO HARMONSIE ITS REGUALTIONS WITH EU ACQUIS

 

The Council of Ministers of BIH adopted Information of the Directorate for European Integrations on application of a Decision on instruments for harmonisation of BIH legislation with the EU acquis in the time between April 6, 2014 and April 6, 2015, and tasked  initiators of legal regulations to secure expert assistance from the Directorate of European Integrations in the phase of development of legal regulations for the purpose of their harmonisation with the EU acquis. All initiators of legal regulations and institutions’ managers, authorised by the law or other regulations development specific legal provisions, are obliged to submit to the Directorate for European Integrations all regulations for check and confirmation of harmonisation, for the purpose for their harmonisation with the EU acquis, which will be accompanied by orderly filled harmonisation instruments.

Institutions’ mangers are obliged to submit to the Directorate for European Integrations for check and harmonisation confirmation already adopted regulations, not being summited before being adopted.

The session emphasised that after the Stabilisation and Accession Agreement took effect, the mandatory harmonisation gest on its significance even more, as the implementation of commitments has entered into tis intensive phase.

 

 

 

TO MEET INTENRATIONAL OBLIGATIONS

 

The Council of Ministers of BIH took note of information of Office of Agent of the Council of Ministers of BIH before the European Court for Human rights on implementation of Action Plan for execution of general measures under ECHR award in case Hadžić and Suljić vs. Bosnia and Herzegovina, app. No. 39446 and 33848/08.

The Council of Ministers of BIH tasked the state Minister of Justice to cooperate with Republika Srpska Ministers of Justice and Minister of health, and proposed measures, within 3o day deadline, to prepare the Sokolac Institute for admission of patients from throughout BIH, in accordance with signed-to 2009 Agreement between BIH, the Federation of BIH, Rrepublika Srpska and Brčko District.

 

CoM DECIDES ON ACCOMODATION OF BIH ISNTITTUIONS IN MOSTAR

 

The Council of Ministers of BIH, upon a proposal of the General Affairs Service of BIH Institutions, took a decision on distribution of office premises for accommodation of BIH Institutions in Mostar in a facility at Kneza Višeslava Street, of total surface of 1,598.48 m2, namely for accommodation of the Food Safety Agency, General Affairs Service, Agency for Medicines and Medical Material, Centre for Information and Recognition of High Education Documents, Foreigners’ Affairs Service, Competition Council of BIH, Institute for Missing Persons, Foreign Investment Promotion Agency, State Regulatory Agency for Radiation and Nuclear Safety, Institution of Ombudsman for Human Rights of BIH and Mine Action Centre of BIH.

The Council of Ministers of BIH took note of information of the General Affairs Service of BIH Institutions on the issue of accommodation of BIH Institutions. The Joint Affairs Service is tasked to prepare a proposal for accommodation of BIH Institutions in East Sarajevo, taking cate that all institutions in newly procured objects enjoy optimal conditions for regular operations from their competences, including observed normative for accommodation of employees in BIH Institutions of eight m2 per employee.

The General Affairs Service of BIH Institutions is tasked to prepare and submit to the Council of Ministers of BIH proposal decisions to regulate the issue of procurement of facilities for accommodation of BIH Institutions in Sarajevo, after the BIH Attorney’s Office failed to grant its consent for purchase of the Hidrogradnja Building in Sarajevo. Namely, the Attorney’s Office noted a possibility of both activation of mortgage over the facility, as warned by notary in drafting a sales contract, and of claims secured by mortgage contract  with UNION Bank over the facility.

The Council of Ministers of BIH tasked the General Affairs Service of BIH Institutions to cooperate with the Ministry of Foreign Affairs and prepare an inventory of buildings in Sarajevo in state ownership - once rented to embassies of foreign countries but not used by them any longer - in order to use them for the accommodation of BIH Institutions and thus make budget savings. Also, the General Affairs Service is tasked to make inventory of all other objects in state ownership, to include data on locations, surface, status of premises, i.e. needed costs for adaptation of premises for accommodation of BIH Institutions.

 

WITNESS PROTECTION PROGRAMME COMMITTEE APPOINTED

 

The Council of Ministers of BIH, upon a proposal of the Ministry of Security, took a  Decision to appoint Davorin Jukić from the BIH Court, Goran Salihović from BIH Prosecutor’s Office and Vahid Alagić from the State Investigations and Protection Agency for members of the Witness Protection Programme Committee in BIH.

 

The Council of Ministers of BIH, upon a proposal of the Ministry for Human Rights and Refugees, took a decision on amendment of the decision on appointment of National Coordinator for Roma issues in BIH. Minister for Human Rights and Refugees Semiha Borovac was appointed for the National Coordinator in 2015, replacing the previous Minister.

 

The Council of Ministers of BIH, upon a proposal of the Ministry of Security, took a conclusion on sending Adnan Mahmutović, police officer, member of the BIH Border Police, as BIH liaison officer with the SECI/SELEC Bucharest-based Anti-Cross-Border Crime Centre for a two year term, starting as at July 1, 2015.
