Council of Ministers of B-H Holds Its 159th Session

The Proposal Law will be of identical text as the Law promulgated by the High Representative for B-H, based on his authorisations.
The proposer, Ministry of Justice, will provide the Proposal Law to the Parliamentarian Assembly for consideration under an urgent procedure.
The Council of Ministers of B-H adopted, by a majority vote, a Proposal Law on Adoption of a Law on Amendments and Supplements to the Law on Court of Bosnia and Herzegovina.

The Council of Ministers of B-H adopted, by a majority vote, a Proposal Law on Adoption of a Law on Amendments and Supplements to the Code of Criminal Procedure of Bosnia and Herzegovina.

The Council of Ministers of B-H adopted, by a majority vote, a Proposal Framework Law on Establishing Collective Joint Register of Non-Government Organisations in Bosnia and Herzegovina.
The proposer, Ministry of Justice, will provide the Proposal Law to the Parliamentarian Assembly for consideration under a regular procedure.
The Council of Ministers of B-H defined Proposal Basics for conclusion of an Addendum to the Finance Agreement between Bosnia and Herzegovina and the European Commission on the Croatia - Bosnia and Herzegovina Cross-Border Cooperation Programme under IPA Cross-Border Cooperation Component for 2008.
The proposer, Ministry of Finance and Treasury, will provide the Proposal Basics to the B-H Presidency for further procedure, and Head of Directorate for European Integrations Nevenka Savić is proposed as the B-H signatory of the Addendum to the Finance Agreement.
The Council of Ministers of B-H defined Proposal Basics for conclusion of an Addendum to the Finance Agreement between Bosnia and Herzegovina and the European Commission on the Serbia - Bosnia and Herzegovina Cross-Border Cooperation Programme under IPA Cross-Border Cooperation Component for 2008.

The Council of Ministers of B-H defined Proposal Basics for conclusion of an Addendum to the Finance Agreement between Bosnia and Herzegovina and the European Commission on the Montenegro - Bosnia and Herzegovina Cross-Border Cooperation Programme under IPA Cross-Border Cooperation Component for 2008.
The proposer, Ministry of Finance and Treasury, will provide the Proposal Basics to the B-H Presidency for further procedure, and Head of Directorate for European Integrations Nevenka Savić is proposed as the B-H signatory of the Addendum to the Finance Agreement.
The Council of Ministers of B-H defined Proposal Basics for conclusion of an Addendum to the Finance Agreement between Bosnia and Herzegovina and the European Commission on Funding Bosnia and Herzegovina’s Participation in ERDF International Cooperation European Programmes “South-East Europe” and “Mediterranean”, based on IPA Cross-Border Cooperation Component for 2008.
The proposer, Ministry of Finance and Treasury, will provide the Proposal Basics to the B-H Presidency for further procedure, and Head of Directorate for European Integrations Nevenka Savić is proposed as the B-H signatory of the Addendum to the Finance Agreement.
The Council of Ministers of B-H defined Proposal basics for negotiations for conclusion of an Agreement between the Ministry of Civil Affairs of Bosnia and Herzegovina and Ministry of Education of the Republic of Azerbaijan on Cooperation in Education.
The proposer, Ministry of Civil Affairs, will provide the Proposal Basics to the B-H Presidency for further procedure, and Sredoje Nović Minister of Civil Affairs is proposed as the B-H signatory of the Agreement.
The Council of Ministers of B-H defined Proposal basics for launching a procedure for conclusion of an Agreement on RACVIAC Security Cooperation Centre.
The proposer, Ministry of Foreign Affairs, will provide the Proposal Basics to the B-H Presidency for further procedure.
The Council of Ministers of B-H considered and accepted an Initiative for negotiations for conclusion of a Loan Agreement between Bosnia and Herzegovina and the Saudi Fund for Development to finance the Srebrenik Municipality Administration Building Construction.
In regard to that, the following delegation members were appointed:
- Minister of Finance and Treasury, or an authorised person – head of the negotiating team;
- Federal Minister of Finance, or an authorised person;
- Head of the Srebrenik Municipality, or an authorised person;
Following negotiations, the Ministry of Finance and Treasury will act in compliance with Article 39 paragraph (4) of the Law on Borrowing, Debt and Guarantees of Bosnia and Herzegovina (“Official Gazette of B-H”, Nos. 52/05 and 103/09), and will deliver the Draft Agreement and basics for conclusion of the Agreement with accompanying documents to the Council of Ministers.
The Council of Ministers of B-H considered and accepted an Initiative for negotiations for conclusion of Loan Agreement between Bosnia and Herzegovina and the Saudi Fund for Development to finance the “Sustainable Refugee Return: Reconstruction of Housing Units and Infrastructure”
In regard to that, the following delegation members are appointed:
- Minister of Finance and Treasury, or an authorised person – head of the negotiating team; and
- Minister for Human Rights and refugees, or an authorised person.
Following negotiations, the Ministry of Finance and Treasury will act in compliance with Article 39 paragraph (4) of the Law on Borrowing, Debt and Guarantees of Bosnia and Herzegovina (“Official Gazette of B-H”, Nos. 52/05 and 103/09), and will deliver the Draft Agreement and basics for conclusion of the Agreement with accompanying documents to the Council of Ministers.
The Council of Ministers of B-H defined individual proposal decisions for ratification of the following international treaties:
- Proposal Decision on Ratification on a Loan Agreement (“East Sarajevo University Modernisation Project”) between the Council of Ministers of Bosnia and Herzegovina, represented by the Ministry of Finance and Treasury, and Raiffeisen Bank International AG;
- Proposal Decision on Ratification of an Agreement between SEE Health Network member countries on Host Country and SEE Health Network Secretariat Seat Arrangement;
- Proposal Decision on Ratification of the UNIDROIT Convention on Stolen or Illegally Exported Cultural Objects, adopted at the Diplomatic Conference in Rome on June 24, 1995;
- Proposal Decision on Ratification of an Amendment of Article 20, paragraph (1) of the UN Convention on Elimination of All Forms of Discrimination against Women, adopted by the UNSC resolution No. A/RES/50/202;
- Proposal Decision on Ratification of an Amendment of the Finance Agreement between Bosnia and Herzegovina and the International Development Association (IDA) for SEE Energy Community Programme – ESCEE Project (Loan No. 4197-BOS);
- Proposal Decision on Ratification of a Finance Agreement (Additional Financing for the Health Sector Strengthening Project) between Bosnia and Herzegovina and the International Development Association;
- Proposal Decision on Ratification of a Soft Loan Agreement between Bosnia and Herzegovina, represented by the Ministry of Finance and Treasury, and Erste Bank Der Oesterreichischen Sparkassen AG for the „Medical Euqipment Provision for the Genral Hospital in Nevesinje Project“.
- Proposal Decision on Ratification of an Amendment No. 3 of the Finance Agreement of Feb. 22, 2006 (“Finance Agreement”) - European Fund for Bosnia and Herzegovina Housing Loans Programme-MSEs Loans Programme - between the Council of Ministers Bosnia and Herzegovina (“Council of Ministers”), represented by the Ministry of Finance and Treasury, and KfW, Frankfurt am Main (“KfW”);
- Proposal Decision on Ratification of an Amendment of the Agreement in relation to EUR 17,000,000.00 Finance Agreement of June 23, 2008 (“Finance Agreement”) between Bosnia and Herzegovina, represented by the Ministry of Finance and Treasury (“Borrower”), the Federation of Bosnia and Herzegovina, represented by the Federal Ministry of Finance, Power Utility of the Croatian Community of Herzeg-Bosnia Ltd. Mostar (EP HZHB) (“Project Implementing Agency”) and Kreditanstalt fur Wiederaufbau, Frankfurt am Main (“KfW”) for the Rama Hydro Power Plant Rehabilitation Project;
- Proposal Decision on Ratification of a Loan Contract (Water Supply and Sanitation in Sarajevo Project) between Bosnia and Herzegovina and the European Bank for Reconstruction and Development.
The proposer, Ministry of Foreign Affairs, will provide the Proposal Decisions to the B-H Presidency for adoption.
Upon a proposal by the Ministry of Civil Affairs, the Council of Ministers of B-H took a Decision to adopt the “Proportional Increase of Universal Access for Most Vulnerable Population Groups in Bosnia and Herzegovina” Project.
Upon a proposal by the Ministry of Civil Affairs, the Council of Ministers of B-H took a Decision to adopt a Project titled “DOTS Strategy Enhancement and Promotion of Counter-TBC National Programme, Including Multiresistant TBC and Contagion Control in Bosnia and Herzegovina”.
Upon a proposal by the Ministry of Civil Affairs, the Council of Ministers of B-H took a Decision on Amendment of the Decision Establishing a Committee for Certification of Poliomyelitis Eradication in Bosnia and Herzegovina.
Upon a proposal by the Ministry of Foreign Ttrade and Economic Relations, the Council of Ministers of B-H took a Decision on Ban of Import and Transportation of Certain Deliveries to and in Bosnia and Herzegovina for the reason of prevention of African Swine Flu.
Upon a proposal by the Ministry of Foreign Trade and Economic Relations, the Council of Ministers of B-H took a Decision on Ban of Import and Transportation of Certain Deliveries to and in Bosnia and Herzegovina for the reason of prevention of the Bluetongue Disease.
Upon a proposal by the Ministry of Civil Affairs, the Council of Ministers of B-H took a Decision to adopt an Action Plan for enhancing basic capacities for effective implementation of international health regulations (2005) in Bosnia and Herzegovina in 2011-2013.
Upon a proposal by the Ministry of Security, the Council of Ministers of B-H took a Decision to set-up a Work Group for Development and Implementation Monitoring of an Action Plan for Prevention and Suppression of Criminal Acts Concerning Motor Vehicles for 2011-2014.
Upon a proposal by the Ministry of Security, the Council of Ministers of B-H took a Decision on implementation of restrictive measures against Liberia, defined under the following UNSC resolutions: 1521 (2003), 1532 (2004), 1683 (2006), 1731 (2006), 1854 (2008), 1903 (2009), and 1961 (2010).
The Council of Ministers of B-H considered and adopted Information of the Ministry of Security of Bosnia and Herzegovina on realisation of an international computer simulation exercise “SEESIM 10”, held on October 18-24, 2010.
It was concluded that the Ministry of Security, in cooperation of the Ministry of Defence of B-H and other institutions and administrative bodies of B-H, Entities and the Brčko District, should consider possibilities, and plan and implement the “SEESIM 12” exercise.
Upon a proposal by the Ministry of Security, the Council of Ministers of B-H took a Decision on Appointing a Work Group for Coordination and Implementation Monitoring of Bosnia and Herzegovina’s 2009-2012 Strategy for Fight against Organised Crime Action Plan.
Upon a proposal by the Ministry of Security, the Council of Ministers of B-H took a Decision on appointing Bosnia and Herzegovina’s representative into a Joint Coordination Body for Monitoring of the Agreement between the Council of Ministers of Bosnia and Herzegovina and Government of the Republic of Croatia on Cooperation in State Border Monitoring.
The Council of Ministers of B-H considered and adopted the HIV/AIDS 2011-2016 Strategy in Bosnia and Herzegovina, with proposed conclusions.
The Council of Ministers of B-H considered and adopted Information of the Ministry of Civil Affairs concerning a memorial exhibition in the Auschwitz-Birkenau Centre Pavilion 17, in Poland, with proposed conclusions.
The Council of Ministers of B-H considered and adopted Information of the Ministry of Civil Affairs on non-spending of current Budget reserves resources approved to the Institute for Measurement of Bosnia and Herzegovina, and in that regard it concluded the following:
- The Directorate for European Integrations is tasked to request from the Delegation of European Union in B-H an extension of the implementation period for the European Commission Project “Establishment of Calibration Laboratory for Ionising Radiation in B-H”, financed from the IPA funds;
- The B-H Institute for Measurement is tasked to initiate a procedure, following the adoption of 2011 B-H Budget, for funds approval from the Budget current reserves for the purpose of establishment of the State Calibration Laboratory for Ionising Radiation.
The Council of Ministers of B-H considered and adopted Information of the Ministry of Finance and Treasury on preparations and construction of the Bijača border-crossing on Southern section of Corridor V c Motorway.
The Council of Ministers proposed to the Government of the Federation of B-H to accept the Information and act accordingly.
Also, the Ministry of Finance and Treasury and Ministry of Communications and Transport are charged to implement the propositions form the Information, in coordination with the Government of the Federation of B-H.
The Council of Ministers of B-H considered and adopted Information of the Directorate for European Integrations on the third meeting of the Transitional Board for Innovations, Information Society, Social Policy and Public Health, held in Sarajevo, on June 15 and 16, 2011, with proposed conclusions.
The Council of Ministers of B-H considered and adopted Information of the Directorate for European Integrations on the fourth meeting of the Transitional Board for Stabilisation and Accession between the European Commission and Bosnia and Herzegovina, held in Brussels, on June 27 and 28, 2011, with proposed conclusions.
In regard to that, competent Ministries and administrative bodies of B-H are tasked to undertake all measures required for timely fulfilment of European Commission recommendations.
The Council of Ministers of B-H considered and Information on a visit by a representative of the Ministry of Security to Bosnia and Herzegovina’s police officers serving in the UN Peace Keeping Mission on Cyprus.
It was concluded that the Information should be turned back to the Ministry of Security so that needed consultations would be made and opinion of the Ministry of Finance and Treasury obtained before the decision making on the proposed conclusions.
The Council of Ministers of B-H considered and adopted Information of the B-H State Committee for Integrated Border Management on establishment of a joint site in the regime of control at the International Border-Crossing Gradina-Jasenovac, and in regard to that it made the following conclusions:
- A consent will be given to the Republic of Croatia’s competent institutions concerning the process of moving of needed infrastructure from the International Border-Crossing Jasenovac in the Republic of Croatia for the purpose of its operation at the future joint site of the International Border-Crossing Gradina-Jasenovac, in the territory of Bosnia and Herzegovina, starting from September 12, 2011 until its final operability;
- The State Committee for Integrated Border Management is tasked to intensify its activities on development of a new contract on joint
The Council of Ministers of B-H considered and adopted Information of the Committee for Certification of Poliomyelitis Eradication in Bosnia and Herzegovina for 2010.
In regard to that, the Ministry of Civil Affairs is in charge to pay, in accordance with Article 6 of the Decision on Establishment of the Committee for Certification of Poliomyelitis Eradication in B-H (“Official Gazette of B-H”, No. 95/08) and Article 5 of the Decision on Establishment of Expert Committee for Poliomyelitis in B-H (“Official Gazette of B-H”, No. 95/08), one-time reimbursement in amount of KM 500 from the current expenditures for 2011to experts appointed by Entity Ministries of Health and Brčko District Health and Other Services Department, not being representatives of B-H-level institutions.
Upon a proposal of the Food Security Agency, the Council of Ministers of B-H took Regulations on Amendments and Supplements to Regulations on Plastic Maters and Items Intended for Contact with Food.
The Council of Ministers of B-H was informed of a Proposal Assessment of Justifiability of Participation of B-H Armed Forces Instructors in the International Security Assistance Forces in Afghanistan (ISAF), and in regard to that it concluded the following:
- The Council of Ministers assesses as justifiable the participation of the B-H Armed Forces instructors in the ISAF Mission in Afghanistan;
- The Council of Ministers tasks the Ministry of Defence to provide to the Presidency of B-H the Assessment of Justifiability of Participation of B-H Armed Forces Instructors in the ISAF Mission in Afghanistan with a Proposal Decision on Participation of B-H Armed Forces Instructors in the ISAF Mission in Afghanistan.
The Council of Ministers of B-H was informed of a Proposal Assessment of Justifiability of Participation of a Non-Commissioned Officer of the B-H Armed Forces in the International Security Assistance Forces in Afghanistan (ISAF), and in regard to that it concluded the following:
- The Council of Ministers assesses as justifiable the participation of a non-commissioned officer of the B-H Armed Forces in the ISAF Mission in Afghanistan;
- The Council of Ministers tasks the Ministry of Defence to provide to the Presidency of B-H the Assessment of Justifiability of Participation of a Non-Commissioned Officer of the B-H Armed Forces in the ISAF Mission in Afghanistan with a Proposal Decision on Participation of a Non-Commissioned Officer of the B-H Armed Forces in the ISAF Mission in Afghanistan.
The Council of Ministers of B-H was informed of a Conclusion of the House of Representatives of the Parliamentarian Assembly of B-H, adopted at the 7th session of the House, regarding a discussion on a Proposal Law on Amendments and Supplements to the Law on Associations and Foundations in B-H, tasking the Council of Ministers for a review of the consents issued to-date for the use of the name “Bosnia and Herzegovina” in the titles of these organisations, in the period from 2004 to-date, and to prepare a report of related activities for the House of Representatives.
The Ministry of Justice is in charge to implement the conclusions.
The Council of Ministers of B-H was informed of Conclusions of the House of Peoples of the Parliamentarian Assembly of B-H, adopted at the 4th session of the House, regarding consideration of audit reports for 2009.
In regard to a conclusion requiring an initiation of a procedure for the selection of bodies of the B-H Institute for Missing Persons, the Council of Ministers concluded that it had already, at its 156th session, tasked the Ministry for Human Rights and Refugees to start the procedure, in accordance with the Law, for selection and appointment of the Managing and Supervisory Board of the Institute for Missing Persons.
The Ministry for Human Rights and Refugees is tasked to speed-up the procedure of selection of bodies in the Institute for Missing Persons.
In regard to a conclusion requiring an initiation of a procedure for the selection of the Communications Regulatory Agency Manager and Council, the Ministry of Transport and communications is tasked to undertake all legally prescribed measures to finalise the procedure of selection of the CRA Manager and CRA Council members, whose term has expired.
The Council of Ministers of B-H was informed of a letter – conclusion of the B-H Parliamentarian Assembly House of Representatives Joint Committee for Human Rights, Rights of Child, Youth, Immigration, Refugees, Asylum and Ethics, No. 03/6-50-1-12-2/11, of July 27, 2011.
Concerning the conclusion, the Council of Ministers had already, at its 156th session, suggested to the Parliamentarian Assembly of B-H to set-up a Work Group for preparation of documents for implementation of the ECHR decision in case “Sejdić and Finci vs. B-H”, and expressed its readiness to designate its members in such Work Group, if assessed as appropriate by the Parliamentarian Assembly.
The Secretariat-General will inform the B-H Parliamentarian Assembly of this position.
The Council of Ministers of B-H was informed of an initiative by Dušanka Majkić, Deputy in the House of Representatives of the Parliamentarian Assembly of B-H, requiring from the Council of Ministers an analysis of the effectiveness of activities and justifiability of further existence of the following institutions:
- Agency for High Education Development and Quality Insurance , and
- Commission for Concessions.
The Ministry for Civil Affairs is tasked to review operations and situation in the Agency for High Education Development and Quality Insurance, and propose adequate measures.
The Ministry of Foreign Trade and Economic Relations is tasked to review operations and situation in the Commission for Concessions, and propose adequate measures.
The Council of Ministers of B-H defined responses to deputies’ questions as follows:
- A response of the Ministry of Civil Affairs to a question of Milorad Živković, deputy in the B-H Parliamentarian Assembly House of Representatives;
- A response of the Ministry of Justice to a question of Mehmed Bradarić, delegate in the B-H Parliamentarian Assembly House of Peoples.
The Secretariat-General is tasked to provide the responses to the B-H Parliamentarian Assembly.
The Council of Ministers of B-H took a Decision on allocation of KM 30,000 from the B-H Institutions Budget current reserves to the Chess Federation of Republika Srpska for organisation of the 11th European Youth Championship in Rapid and Blitz Chess.
The Council of Ministers of B-H adopted Information on a necessity of allocation of the Budget funds for the public administration reform.
The Council of Ministers took a Decision on funds allocation to co-finance the Public Administration Reform Fund, from the B-H Institutions Budget for years 2011, 2012, and 2013.
The Council of Ministers of B-H adopted Information on procedures for conclusion of Annex III of the Agreement between Bosnia and Herzegovina and the Kingdom of Norway.
Also, the Council of Ministers defined Draft Basics for conclusion of the Annex III of the Agreement between Bosnia and Herzegovina and the Kingdom of Norway on financing of projects for judiciary and prosecutorial institutions in Bosnia and Herzegovina.
The High Judicial and Prosecutorial Council of B-H (HJPC) is charged to provide the Proposal Basics to the Presidency of B-H, with a proposal to designate HJPC President Milorad Novković for the signatory of the Annex.
Also, the Council of Ministers suggested to the Presidency B-H to take a conclusion on temporary application of the Annex III until its effectiveness.
The Council of Ministers of B-H adopted Information on a revised proposal by the NIPAC for the 2011 IPA Programme funds allocation.
The Directorate for European Integrations of B-H is in charge to send the up-dated project proposals and revised list of project proposals for IPA 2011 Programme to the Delegation of European Union in B-H for adoption.
The Council of Ministers of B-H released form duty Nihad Fejzić Manager of the Agency for High Education and Quality Insurance, on his own request.
The Council of Ministers appointed Boris Ćurković Deputy Manager for acting Manager of the Agency for a 60-day period.
The Ministry of civil Affairs is tasked to implement a job vacancy procedure for selection and appointment of Manger of the Agency for High Education and Quality Insurance.
The Legislative Office is tasked to prepare a decision of release from duty of the Manger, and decision appointing acting Manager, and to forward them to the Chairman of the Council of Ministers for signing.
The Council of Ministers of B-H was informed of a request for issuance of an entry visa to a Kosovo citizen, participant of the USAID-organised First Conference on Regional Cooperation on Sustainable Development of Tourism.
In compliance with the Conclusion from the 86th session of the Council of Ministers, held on may 7, 2009, taken in relation to the position of the Presidency of B-H on legality of documents owned by Kosovo citizens, the Council of Ministers authorises the Ministry of Foreign Affairs to issue entry visas on a separate sheet for one person, referred to in the request for the purpose of his participation at mentioned Conference on September 20-21, 2011 for the period of the Conference.
The Secretariat General of the Council of Ministers is in charge to provide the above conclusion to the Ministry of Foreign Affairs of B-H for further procedure.
The Council of Ministers of B-H was informed of a request for issuance of entry visas to Kosovo citizens invited to take part at the “Open Society Fund” Conference in Sarajevo, on September 29, 2011.
In compliance with the Conclusion from the 86th session of the Council of Ministers, held on may 7, 2009, taken in relation to the position of the Presidency of B-H on legality of documents owned by Kosovo citizens, the Council of Ministers authorises the Ministry of Foreign Affairs to issue entry visas on a separate sheet for six persons referred to in the request for the purpose of their participation at the Conference to be held on September 29 to October 2, 2011 for the period of the event.
The Secretariat General of the Council of Ministers is in charge to provide the above conclusion to the Ministry of Foreign Affairs of B-H for further procedure.
The Council of Ministers of B-H was informed of a request for issuance of an entry visa for a Kosovo citizen for his participation at the Council of Europe Conference “The Role of Human Rights Institutions in Protection against All Forms of Discrimination”, to be held in Sarajevo, on September 27-30, 2011.
In compliance with the Conclusion from the 86th session of the Council of Ministers, held on may 7, 2009, taken in relation to the position of the Presidency of B-H on legality of documents owned by Kosovo citizens, the Council of Ministers authorises the Ministry of Foreign Affairs to issue entry visa on a separate sheet for one person referred to in the request for the purpose of his participation at the Conference to be held on September 27-30, for the period of the event.
The Secretariat General of the Council of Ministers is in charge to provide the above conclusion to the Ministry of Foreign Affairs of B-H for further procedure.
The Council of Ministers of B-H was informed of a request for issuance of entry visas to Kosovo citizens to participate the International Boxing Tournament “Mustafa Hajrulahović - Talijan”, to be held in Sarajevo, on September 10-11, 2011.
In compliance with the Conclusion from the 86th session of the Council of Ministers, held on may 7, 2009, taken in relation to the position of the Presidency of B-H on legality of documents owned by Kosovo citizens, the Council of Ministers authorises the Ministry of Foreign Affairs to issue entry visas on a separate sheet for the persons referred to in the request the purpose of their participation at the tournament, to be held on September 10 and 11, 2011, for the period of the tournament.
The Secretariat General of the Council of Ministers is in charge to provide the above conclusion to the Ministry of Foreign Affairs of B-H for further procedure.
