At today’s, 53rd session, the Council of Ministers of BIH unanimously adopted a report on negotiations for the conclusion of a Contract between Bosnia and Herzegovina and the Republic of Croatia on border crossings, and thus defined a Proposal Contract. 

The Ministry of Security should provide the Proposal Contract to the Presidency of BIH for further procedure.

According to the Contract, the following border crossings were established at the joint state border between BIH and the Republic of Croatia for the international road transport of passengers and cargo, which, subject to the contacting parties’ respective legislation, is subject to inspection controls during the crossing of the joint state border:

1.      Stara Gradiška – Gradiška

2.      Nova Sela – Bijača.

The border crossings for the international road transport of passengers and cargo and for the transport of fruits and vegetables, which pursuant to the contracting parties’ respective legislation is subject to the control of adjustment to market standards and safety during the transport across the joint state border are the following:

1.      Županja – Orašje

2.      Ličko Petrovo selo – Izačić

3.      Vinajni Donji – gorica

4.      Gornji Brgat – ivanica.

The Contract provides for the border crossings for the international transport of passengers and cargo, for the road and railway transport, in addition to permanent border crossings for small border traffic.

The Council of Ministers of BIH unanimously adopted a Report on negotiations for the conclusion of an Agreement between Bosnia and Herzegovina and the Republic of Croatia on border transport, and in that regard it defined a Proposal Agreement.

The Ministry of Security is to provide the Proposal Agreement to the Presidency of BIH for further procedure.

Under the Agreement, the border crossing regime, i.e. system of rules is established to regulate the border traffic in border areas between Bosnia and Herzegovina and the Rrepublic of Croatia.

Population in the border areas can, in accordance with the rules of border crossing regime, and unless there is no ban or restriction provided for in the contracting parties’ respective legislation, cross the joint state border under condition that they show border area pass, they do not represent a threat to public order, internal security, public health or international relations of the Republic of Croatia or Bosnia and Herzegovina or any EU member country, that there is no warning issued against them in parties’ data bases based on denial of entry for the above referenced reasons nor in the Schengen IT system based on denial of entry to the EU territory for the same reasons.

On passing the joint state border under conditions of border area regime, the holders of a border pass are exempted from the application of visa regime.

The Council of Ministers of BIH unanimously defined an Addendum 3 to the Negotiating Position of Bosnia and Herzegovina (negotiations on the Protocol to the Provisional Agreement on Trade and Trade Issues between the European Community, on one side, and Bosnia and Herzegovina, on the other side, in order to take into consideration the accession of the Republic of Croatia to the European Union (Additional Protocol)).

Defining the Additional Protocol, Bosnia and Herzegovina expresses its readiness to launch and complete, within the shortest time possible, the process of technical adjustment of the text Provisional Agreement in all its segments needed for tis smooth application after July 1, 2013.

If the European Commission accepts the request of Bosnia and Herzegovina for an increase of annual customs quotas for products from Bosnia and Herzegovina (fish, vine and sugar) in the quantities already requested in the process of technical adjustment, the BIH Delegation may increase or introduce customs quotas for the same products originating from the European Union in the quantities equal to those in registered average import from the Republic of Croatia to Bosnia and Herzegovina in the time period from 2009 to 2011.

Due to a large discrepancy in quantities and values of registered import of certain products to Bosnia and Herzegovina relative to registered export of the same from Croatia to Bosnia and Herzegovina, the quantities within the customs quotas which the BIH Delegation may approve of the import from the European Union will be defined after the reconciliation of data of the Indirect Taxation Administration of Bosnia and Herzegovina and of the Customs Administration of the Republic of Croatia. The approved quantities cannot be larger than maximum requested quantities by the European Union.

Bosnia and Herzegovina’s Delegation is responsible to inform the European Union immediately on the positions and proposals of Bosnia and Herzegovina.

The conclusion of the Protocol is based on the commitment of Bosnia and Herzegovina to make its relations with the European Union further closer and institutionalised in line with the Stabilisation and Accession Process, as well as to implement the Stabilisation and Accession Agreement, aimed to facilitate substantially BIH’s European integration activities.
