Council of Ministers Holds Its 143rd Session

The proposer, Ministry of Transport and Communications, will provide the Proposal Agreement to the Presidency of B-H for further procedure, and the Minister of Transport and Communications is proposed as the signatory on behalf of B-H.
The Council of Ministers of B-H defined a proposal basis for accession of Bosnia and Herzegovina to a Contract between the Swiss Confederation and Republic of Austria on Establishment and Operation of International Centre for Migration Policy Development (ICMPD) in Vienna.
The proposer, Ministry of Security, will provide the proposal basis to the Presidency of B-H for further procedure.
The Council of Ministers of B-H defined a proposal basis for negotiations for conclusion of a Readmission Agreement between the Council of Ministers of B-H of Bosnia and Herzegovina and Government of the Republic of Indonesia.
The proposer, Ministry of Security, will provide the proposal basis to the Presidency of B.H for further procedure.
The Council of Ministers of B-H defined a proposal basis for negotiations for conclusion of a Readmission Agreement between the Council of Ministers of B-H of Bosnia and Herzegovina and Government of the Federal Republic of Brazil.
The proposer, Ministry of Security, will provide the proposal basis to the Presidency of B.H for further procedure.
The Council of Ministers of B-H defined a proposal basis for negotiations for conclusion of a Readmission Agreement between the Council of Ministers of B-H of Bosnia and Herzegovina and Government of the Kingdom of Morocco.
The proposer, Ministry of Security, will provide the proposal basis to the Presidency of B.H for further procedure.
The Council of Ministers of B-H defined a proposal basis for negotiations for conclusion of a Readmission Agreement between the Council of Ministers of B-H of Bosnia and Herzegovina and Government of the Republic of Argentina.
The proposer, Ministry of Security, will provide the proposal basis to the Presidency of B.H for further procedure.
The Council of Ministers of B-H defined a proposal basis for negotiations for conclusion of a Readmission Agreement between the Council of Ministers of B-H of Bosnia and Herzegovina and Government of the Republic of Philippines.
The proposer, Ministry of Security, will provide the proposal basis to the Presidency of B-H for further procedure.
The Council of Ministers of B-H defined a proposal basis for negotiations on a Loan Agreement to finance the Procurement of Goods and Services for Two Hospitals in Sarajevo Project between Bosnia and Herzegovina, represented by the Ministry of Finance and Treasury, and the UniCredit Bank Austria AG.
The proposer, Ministry of Finance and Treasury, will provide proposal basis to the Presidency of B-H for further procedure, and the Minister of Finance and Treasury is proposed as the signatory of the Agreement on behalf of B-H.
The Council of Ministers of B-H defined a proposal basis for negotiations for conclusion of Grant Agreement within IPA 2009 State Programme for Bosnia and Herzegovina – Water Supply and Sanitation Infrastructure, between Bosnia and Herzegovina and the European Investment Bank.
The proposer, Ministry of Finance and Treasury, will provide proposal basis to the Presidency of B-H for further procedure, and the Minister of Finance and Treasury is proposed as B-H signatory of the Agreement.
The Council of Ministers of B-H defined a proposal basis for negotiations for conclusion of a Cooperation Agreement in Defence between the Council of Ministers of Bosnia and Herzegovina and Government of the Republic of Croatia.
The proposer, Ministry of Defence, will provide the proposal basis to the Presidency of B-H for further procedure, and the Minister of Defence is proposed as B-H signatory of the Agreement.
The Council of Ministers of B-H defined individual proposal decisions on ratification of Contracts and Agreements, as follows:
- Proposal decision on ratification on an Agreement between the Council of Ministers of B-H of Bosnia and Herzegovina and Government of the Republic of Serbia on Cooperation in Tourism;
- Proposal decision on ratification of an Amendment of the Agreement on Financial Cooperation between the Council of Ministers of B-H of Bosnia and Herzegovina, represented by the Ministry of Finance and Treasury, and Government of the Republic of Austria, represented by the Federal Minister of Finance;
- Proposal decision on ratification of an Agreement on Cultural Cooperation between the Council of Ministers of B-H of Bosnia and Herzegovina and Government of Malaysia;
- Proposal decision on ratification of an Agreement between the Council of Ministers of B-H of Bosnia and Herzegovina and Government of the Republic of Croatia on Financing and Development of Main Project and Administrative Procedure for Environment Impact Assessment, Obtaining Location Permits, Consents and Construction Permits for the Reconstruction and Modernisation of the of Sava River Waterway from Račinovac to Sisak Project.
The proposer, Ministry of Foreign Affairs, will provide the proposals to the Presidency of B-H for adoption.
The Council of Ministers of B-H considered and accepted an Initiative for negotiations for conclusion of an Agreement on Loan, Financing and Projecting between the KfW, Frankfurt am Main, and Bosnia and Herzegovina, represented by the Ministry of Finance and Treasury (Borrower), Federation of Bosnia and Herzegovina, represented by the Federal Ministry of Finance, and Republika Srpska, represented by the Ministry of Finance of Republika Srpska, and Public Company Power Utility B-H Sarajevo (EP BiH), Public Company Power Utility of Hrvatske Zajednice Herceg-Bosne Mostar (EP HZHB) and Public Company Power Utility Republike Sprske Trebinje (EP RS) for EUR 17 million – SCADA/DMS/OMS – at distribution level.
For the negotiations, the following delegation members are designated:
- Minister of Finance and Treasury – or an authorised person – head of negotiating team;
- Federal Minister of Finance, or an authorised person;
- Minister of Finance of Republika Sprska, or an authorised person;
- Manager of EP BiH, or an authorised person;
- Manager of EP HZHB, or an authorised person, and
- Manager of EP RS, or an authorised person.
Following the negotiations, the Ministry of Finance and Treasury will act in accordance with Article 39 paragraph 4 of the Law on Borrowing, Debt and Guarantees of B-H (“Official Gazette of B-H”, No. 52/05), and will provide a Draft Loan Agreement and Basics for conclusion of the Loan Agreement to the Council of Ministers of B-H.
The Council of Ministers of B-H considered and adopted an Initiative for negotiations for conclusion of Amendment No.1 of the Financial Agreement for National Roads: Banja Luka – Gradiška Project between Bosnia and Herzegovina and the European Investment Bank, signed on November 11, 2005.
The Council of Ministers of B-H considered and adopted an Initiative for negotiations for conclusion of Amendment No. 1 of the Financing Contract for the Power Reconstruction II Project between Bosnia and Herzegovina and the European Investment Bank, signed on December 22, 2006 in Sarajevo and on January 6, 2007 in Luxembourg.
The Council of Ministers of B-H considered and accepted an Initiative for negotiations for conclusion of an Agreement on Loan, Financing and Projecting between the KfW, Frankfurt am Main, and Bosnia and Herzegovina, represented by the Ministry of Finance and Treasury (Borrower), Federation of Bosnia and Herzegovina, represented by the Federal Ministry of Finance, and Republika Srpska, represented by the Ministry of Finance of Republika Srpska, for the Debt Swap 3.
For the negotiations, the following delegation members are designated:
- Minister of Finance and Treasury – or an authorised person – head of negotiating team;
- Federal Minister of Finance, or an authorised person; and
- Minister of Finance of Republika Sprska, or an authorised person.
Following the negotiations, the Ministry of Finance and Treasury will act in accordance with Article 39 paragraph 4 of the Law on Borrowing, Debt and Guarantees of B-H (“Official Gazette of B-H”, No. 52/05), and will provide a Draft Separate Arrangement and basics for conclusion of the Separate Arrangement to the Council of Ministers of B-H.
The Council of Ministers of B-H considered and adopted an Initiative for negotiations for conclusion of a Financing Contract for Corridor 5 c Phase II Project between Bosnia and Herzegovina and the European Investment Bank.
For the negotiations, the following delegation members are designated:
- Minister of Finance and Treasury, or an authorised person – head of negotiating team;
- Federal Minister of Finance, or an authorised person;
- Federal Minister of Transport and Communications, or an authorised person;
- Manager of the Federal Directorate for Construction, Operation and Maintenance of Motorways, or an authorised person.
Following the negotiations, the Ministry of Finance and Treasury will act in accordance with Article 39 paragraph 4 of the Law on Borrowing, Debt and Guarantees of B-H (“Official Gazette of B-H”, No. 52/05), and will provide a Draft Financing Contract and Basics for conclusion of the Draft financing Contract to the Council of Ministers of B-H.
The Council of Ministers of B-H considered and adopted an Initiative for negotiations for conclusion of an Arrangement between the Council of Ministers of B-H of Bosnia and Herzegovina and Government of the Republic of Korea concerning a Economic Development Fond Loan and Loan Agreement between the Council of Ministers of B-H of Bosnia and Herzegovina, Republika Srpska and Export-Import Bank Korea for the Hospital Modernisation in B-H Phase III Project.
Upon a proposal of the Ministry of Security, the Council of Ministers of B-H appointed Mato Miletić, Assistant Minister of Security, as the B-H signatory of an Agreement on Security Regulations for Protection of Chiasmus Software and Chiasmus Crypto Keys.
Upon a proposal of the Ministry of Civil Affairs, the Council of Ministers of B-H took a Decision on Amendment of the Decision on Appointment of B-H representative to Council of Europe EUROIMAGES Fund for Film Co-production.
Upon a proposal from the Ministry of Security, the Council of Ministers of B-H took a Decision on Supplement to the Decision on Annulment of the Decision on Verification of Regulations on Internal Organisation and Structure of the Office for Cooperation with Interpol, No. 253/10, of September 14, 2009.
Upon a proposal of the Central Election Committee, the Council of Ministers of B-H took a Decision approving the implementation of the Single Electoral Information System of Bosnia and Herzegovina Project, to be included into the Multiyear Capital Investment Programme for 2010-2012.
Upon a proposal of the Ministry of Foreign Trade and Economic Relations, the Council of Ministers of B-H took a Decision on Establishment of the Entrepreneurship Development and Promotion Forum in Bosnia and Herzegovina.
The Council of Ministers of B-H considered and adopted a report of the Ministry of Civil Affairs on the Project of Candidacy of Necropolis with Medieval Stone Tombs for Inclusion into the UNESCO World Heritage Tentative List , and in regard to that, it concluded the following:
- the competent Ministries for Culture, institutes for cultural heritage protection, municipalities, Commission for Preservation of National Monuments in B-H and State Committee for Cooperation with UNESCO are recommended to cooperate in the project related activities for as high quality as possible realisation of the project;
- the Ministry of Civil Affairs and Commission for Preservation of National Monuments in B-H are in charge to include relevant experts from Entity Institutes for protection of cultural-historic heritage into development of a nomination file and project management plan; and
- Entity, cantonal and municipal governments are recommended to provide funds in their respective 2011 budgets to support the project and protect necropolis with medieval stone tombs.
The Council of Ministers of B-H considered a report of the Ministry of Security on launching activities on establishment of a network of B-H police liaison officers in the region, Europol and some EU countries.
In regard to that, the Ministry of Security is in charge to start the activities, in cooperation with the Ministry of Foreign Affairs, to set-up the network of police liaison officers according to international conventions and bilateral agreements.
The Council of Ministers of B-H considered and adopted a report of the General Affairs Service of B-H Institutions on taking over the restaurant of the State Investigations and Protection Agency, and concluded the following:
- the General Affairs Service of B-H Institutions is in charge to start offering catering services in the restaurant of the State Investigation and Protection Agency ;
- the General Affairs Service of B-H Institutions in charge to determine, in cooperation with the Ministry of Finance and Treasury, a necessary number of employees and approve employment, as appropriate, based on Regulations on the Internal Organisation of the General Affairs Service of B-H Institutions.
The Council of Ministers of B-H considered and adopted a Revised Basic Document as a part of the Report of Bosnia and Herzegovina as a Member State of the UN.
In regard to that, the Ministry for Refugees and Displaced Persons is in charge to deliver the document to the UN Secretariat General, in due course.
The Council of Ministers of B-H considered and adopted a Programme of Marking the Relevant Human Rights Promotion Dates in Bosnia and Herzegovina for 2011, and concluded the following:
- the competent State Ministries are in charge to participate in the realisation of the Programme of Marking the Relevant Human Rights Promotion Dates in B-H, within their competences, and in cooperation with the Ministry of Human Rights and Refugees.
As the implementation of the Programme would require certain funds, the competent institutions of the Council of Ministers are in charge to implement certain programme-related activities within their budgets in 2011.
Upon a proposal of the Ministry of Foreign Trade and Economic Relations, the Council of Ministers of B-H adopted a Regulation on Amendments and Supplements to the Regulations on Marking ad Control of Movement of Animals in Bosnia and Herzegovina.
Upon a proposal of the Ministry of Foreign Trade and Economic Relations, the Council of Ministers of B-H adopted Regulations on Measures for Prevention and Extermination of Foot and Mouth Disease.
The Council of Ministers of B-H granted its consent to the specification of working posts of secondary education level classified by salary levels, in the following institutions:
- Appeals Committee of the State Civil Service Agency;
- Agency for Preschool, Primary and Secondary School Education; and
- State Regulatory Agency for Radiation and Nuclear Safety.
The consent is granted with an accompanying obligation to harmonise the specifications with an opinion of the Ministry of Finance and Treasury. With the same requirement, the Council of Ministers of B-H granted its consent to the specification of working posts of secondary education level classified by salary levels, in the following institutions:
- Presidency of B-H;
- Ministry of Defence;
- Agency for labour and Employment of B-H; and
- Parliamentarian Assembly of B-H.
The Council of Ministers of B-H accepted a request for release form duty of Esad Tuzović, Manager of the Institute for Measurement of B-H, because of the expiry of his term of office.
The Legislative Office of The Council of Ministers of B-H is in charge to prepare the relevant decision and submit it to the Chairman of the Council of Ministers of B-H for signing.
The Council of Ministers of B-H accepted a proposal for a release from duty of Enes Čengić, Manager of the State Regulatory Agency for Radiation and Nuclear Safety, because of his voluntarily leaving of the civil service.
The Legislative Office of The Council of Ministers of B-H is in charge to prepare the relevant decision and submit it to the Chairman of the Council of Ministers of B-H for signing.
The Civil service Agency of B-H is in charge to publish job vacancy for the post of Manager of the State Regulatory Agency for Radiation and Nuclear Safety within 15 days.
The Council of Ministers of B-H charged the public Procurement Agency to organise free-of-charge seminars four times a year for employees in B-H Institutions in the offices of B-H Institutions in Sarajevo, Mostar and Banja Luka.
Following the seminars, the Agency is obliged to issue certificates to all participants.
The Council of Ministers of B-H considered a report on a control of relevant documentation in respect to funds spending for procurement of facilities for some B-H Institutions, seated in Mostar.
The Report was prepared by the Supervisory Board for Control of Funds Spending for Procurement/Construction of Facilities for B-H Institutions.
Upon a proposal of the General Affairs Service of B-H Institutions, the Council of Ministers of B-H took a Decision on the level of reimbursement to the Committee for Implementation of the Project of Procurement/Construction of Facilities for B-H Institutions.
Upon a proposal of the Ministry of Security, the Council of Ministers of B-H took a Decision on Supplement to the Decision on Taking Over Operations, Facilities, Resources and Employees between the Ministry of Security of Bosnia and Herzegovina, State Investigations and Protection Agency and Directorate for Police Bodies Coordination.
